b. <br />The Developer is responsible for roadway infrastructure construction costs associated <br />146 <br />with a right turn lane along Twin Lakes Parkway between Cleveland Avenue and the <br />147 <br />round-about at Mount Ridge Road. <br />148 <br />c. <br />The Developer is responsible for a $400,000 contribution regarding future roadway <br />149 <br />infrastructure construction costs associated with the interchange with Cleveland <br />150 <br />Avenue and I-35W. <br />151 <br />d. <br />The Developer is responsible for environmental investigation and remediation and <br />152 <br />must prepare a Response Action Plan under the direction of the Minnesota Pollution <br />153 <br />Control Agency. <br />154 <br />e. <br />The Developer is responsible for a payment in lieu of park land dedication in the <br />155 <br />amount of $411,115. <br />156 <br />f. <br />Upon final calculation of all public roadway infrastructure costs, the Developer will <br />157 <br />be responsible for submitting a cash deposit of 125% the final cost for said <br />158 <br />improvements. <br />159 <br />g. <br />The City will construct all roadway infrastructure improvements. <br />160 <br />7.3As discussed above, Police Chief Mathwig recommends replacing the condition of <br />161 <br /> approval pertaining to calls for police service with a requirement for <br />PRELIMINARY PLAT <br />162 <br />Wal-Mart to work with the Roseville Police Department to develop a security plan for the <br />163 <br />property that will help to reduce the calls for service rather than simply penalize Wal- <br />164 <br />Mart for service calls beyond a certain quantity. Such a requirement seems best <br />165 <br />incorporated into the development agreement, with the security plan produced as a <br />166 <br />separate document that will continue to be in effect after the development is completed <br />167 <br />and the development agreement is no longer relevant. <br />168 <br />8.0R <br />ECOMMENDATION <br />169 <br />Consistent with the recommendation of the Planning Commission pertaining to the <br />170 <br />preliminary plat and the approval of the same by the City Council, and based on the <br />171 <br />comments of Sections 4 – 7 of this report, Planning Division staff, Public Works <br />172 <br />Department staff, and the City Attorney recommend approval of the and the <br />FINAL PLAT <br />173 <br />associated,subject to the following conditions: <br />DEVELOPMENT AGREEMENT <br />174 <br />a. <br />Wal-Mart Real Estate Business Trust shall enter into a development agreement <br />175 <br />pertaining to the plat which is satisfactory to the City. Such development agreement <br />176 <br />shall include the requirement that Wal-Mart enter into a security plan approved by the <br />177 <br />Roseville Police Chief which identifies and incorporates on-site technology, <br />178 <br />personnel, and practices to improve security, minimize losses, and better <br />179 <br />communicate with the Police Department. If a mutually agreeable security plan <br />180 <br />cannot be developed, Wal-Mart shall pay for costs related to calls for law <br />181 <br />enforcement service at the Property in excess of 300 calls per year. Calls for law <br />182 <br />enforcement service shall include any calls or service in which persons employed by <br />183 <br />the City and assigned to the Roseville City Police Department are involved. The cost <br />184 <br />for each call in excess of 300 per year shall be determined by adding the cost of all <br />185 <br />City employees (including administrative employees) involved in receiving, <br />186 <br />responding to or providing service with respect to the call. Each employees cost shall <br />187 <br />be determined by multiplying the employee’s hourly rate times 1.9, times the number <br />188 <br />of hours (or portion thereof) expended by such employee regarding the call.
