5.0PA <br />LATNALYSIS <br />104 <br />5.1Plat proposals are reviewed primarily for the purpose of ensuring that all proposed lots <br />105 <br />meet the minimum size requirements of the zoning code, that adequate streets and other <br />106 <br />public infrastructure are in place or identified and constructed, and that storm water is <br />107 <br />addressed to prevent problems either on nearby property or within the storm water <br />108 <br />system. As a plat of a commercial property, the proposal leaves no zoning issues to be <br />109 <br />addressed since the Zoning Code does not establish minimum lot dimensions or area. The <br />110 <br />proposed is included with this report as Attachment D. For the purpose of <br />FINALPLAT <br />111 <br />ensuring the provision of adequate roadway infrastructure, a traffic impact analysis was <br />112 <br />prepared by Wal-Mart’s development team and reviewed by Roseville’s consulting <br />113 <br />traffic engineers; this traffic information is included with this report as Attachment F. <br />114 <br />5.2The 1925 Twin View plat dedicated 40 feet of right-of-way for Mount Ridge Road. Then, <br />115 <br />in 1959, the owner of the property at that time conveyed (via quit claim deed, Ramsey <br />116 <br />County Document No. 1511814) another 10 feet of land on either side of the Mount <br />117 <br />Ridge Road right-of-way “for public road and highway purposes.” Over time, the City <br />118 <br />determined that there was no public purpose in constructing a public road in that location <br />119 <br />or in retaining the unused right-of-way. On July 13, 2009 the City Council adopted <br />120 <br />Resolution 10733 vacating the platted Mount Ridge Road right-of-way and subsequently <br />121 <br />conveyed to Roseville Acquisitions, LLC (via quit claim deed) the two 10-foot strips of <br />122 <br />land flanking the right-of-way. Because the City possessed the 10-foot strips fee title and <br />123 <br />did not acquire them as dedicated right-of-way, they were not vacated with the right-of- <br />124 <br />way conveyed by the plat dedication. We’ve come to learn, however, that Ramsey <br />125 <br />County is insisting that the 10-foot strips must also be vacated because the original quit <br />126 <br />claim deed specified that the land was specifically intended “for public road and highway <br />127 <br />purposes.” Since these 10-foot-wide easements are to be eliminated in the new plat of the <br />128 <br />property, the City Attorney has also recommended the inclusion of condition of <br />FINAL <br />129 <br /> approval that requires the vacation process to be concluded. <br />PLAT <br />130 <br />6.0PC <br />UBLICOMMENT <br />131 <br />No emails, phone calls, or other verbal or written communications pertaining to the <br />FINAL <br />132 <br /> application have been received by Planning Division staff at the time this report <br />PLAT <br />133 <br />was drafted. <br />134 <br />7.0DA <br />EVELOPMENT GREEMENT <br />135 <br />7.1The draft development agreement (included with this report as Attachment G) generally <br />136 <br />specifies the roles and obligations of the City and the developer in the process of <br />137 <br />developing the subject property to ensure that public improvements are properly <br />138 <br />constructed, that environmental remediation is carried out in compliance with the Twin <br />139 <br />Lakes AUAR, that City and the developer are expeditious in the performance of their <br />140 <br />respective duties, and so on. <br />141 <br />7.2The following are the most salient points of the agreement: <br />142 <br />a. <br />The Developer will be responsible for roadway infrastructure construction costs <br />143 <br />associated with the required left/right turn lane improvements along County Road C <br />144 <br />between Cleveland Avenue and Prior Avenue and related to a site access point. <br />145 <br />PF12-001_RCA_072312 <br />Page 4 of 7 <br /> <br />
