operation not to exceed 7:00 a.m. to 9:00 p.m. on weekdays, and 7:00 a.m. to 10:00 p.m. on <br />292 <br />weekends.” <br />293 <br />Councilmember McGehee noted that this proposed development would be locating in Roseville <br />294 <br />and be in direct competition with Target; and questioned what Target’s hours of operation were. <br />295 <br />Mayor Roe noted that the hours of operation most likely varied, and were subject to holiday sales <br />296 <br />as well. <br />297 <br />City Planner Paschke advised that the City’s Zoning Ordinance did not limit hours of operation, <br />298 <br />specific to the Target Store. <br />299 <br />Johnson moved, Willmus seconded, to call the question. <br />300 <br />Roll Call <br />301 <br />Ayes: <br />Pust; McGehee. <br />302 <br />Nays: <br />Willmus, Johnson, Roe. <br />303 <br />Motion failed. <br />304 <br />CONDITION #12 <br />305 <br />Pust moved, Johnson seconded, amendment to the original motion by the addition of <br />306 <br />Condition #12 that: “Wal-Mart Real Estate Business Trust shall agree to enter into a <br />307 <br />Development Agreement satisfactory to the City, which includes a provision that Wal-Mart <br />308 <br />will pay for any law enforcement costs associated with services provided to their operations in <br />309 <br />excess of three hundred (300) calls for service annually. <br />310 <br />Prior to consensus of three hundred (300)calls for service, debate ensued among <br />311 <br />Councilmembers regarding an appropriate number of calls. <br />312 <br />Councilmember Johnson advised that, he would find it difficult to support a condition without <br />313 <br />statistical evidence pertinent to this community and comparable to services provided to similar <br />314 <br />businesses. <br />315 <br />At the suggestion of City Manager Malinen as to whether fire and/or emergency medical calls be <br />316 <br />factored into that equation, Councilmember Johnson, with concurrence of other <br />317 <br />Councilmembers, excluded those calls from the equation to avoid discouraging their use. <br />318 <br />Roll Call <br />319 <br />Ayes: <br />Pust; McGehee; Roe. <br />320 <br />Nays: <br />Willmus; Johnson. <br />321 <br />Motion Failed due to lack of Super-Majority vote <br />. <br />322 <br />Mayor Roe expressed his concern with this motion as stated being somewhat arbitrary in nature <br />323 <br />Councilmember Willmus concurred, opining that it presents a deterrent to public safety. <br />324 <br />Councilmember Johnson duly noted their point, and clarified that his intent was to get to some <br />325 <br />statistical evidence to support an excess of calls; and without a year’s worth of data to back up <br />326 <br />the proposed hours, he was reluctant to support a motion simply based on previously-expressed <br />327 <br />comments about a Wal-Mart store. Councilmember Johnson opined that he was willing to <br />328 <br />stipulate gathering of evidence and leaving it up to a future City Council, by using more lenient <br />329 <br />language; but was not totally convinced that an actual number was needed, but providing for a <br />330 <br />specific trigger. <br />331 <br /> <br />
