Regular City Council Meeting AND <br /> Board of Adjustments and Appeals <br /> Monday,July 16, 2012 <br /> Page 13 <br /> Mayor Roe clarified that the original purpose of the City Council majority in <br /> pursuing the bond issue without referendum was an effort to save public money. <br /> Mayor Roe noted that it was not the City's intent or choice to bring litigation or <br /> file appeals, at the last date possible, to delay the process. <br /> Councilmember McGehee opined that, from the very beginning and at no cost <br /> to taxpayers, a referendum could have been pursued; and further opined that by <br /> choosing not to pursue that option, it was clear that the City had not saved any <br /> money at all, since bond rates had now increased. Councilmember McGehee <br /> noted that she would have to agree to disagree with the City Council majority, <br /> including Mayor Roe. <br /> Mayor Roe opined that the costs incurred by the City were specific to the con- <br /> tinued or threat of litigation of a group of citizens filing in order to seek a refer- <br /> endum; and stood by the City Council majority's decision to save money; and <br /> noted the consequences now being realized based on the choices one group of <br /> citizens had made. <br /> Pust moved, Willmus seconded, a motion to call the question. <br /> Roll Call <br /> Ayes: Pust; McGehee; Willmus; Johnson; and Roe. <br /> Nays: None. <br /> Roll Call (original motion) <br /> Ayes: Pust; McGehee; Willmus; Johnson; and Roe. <br /> Nays: None. <br /> 9. Brewery Tap Room License Ordinance <br /> Finance Director Chris Miller briefly reviewed the requested action detailed in the <br /> RCA dated July 16, 2012; and new category created by the City Council in April of <br /> 2011 for off-sale liquor licenses to accommodate the unique retailing venue of <br /> breweries/brew pubs. However, Mr. Miller noted that current City Code did not al- <br /> low for consumption of alcohol on the premises without an accompanying food <br /> sales requirement, even using the City's authority to establish an on-sale brewer <br /> taproom, under MN State Statute 340A.301, subd. 6b. <br />
