July 11, 2012 1 PLANNING FILE 12-001 2 Request by Roseville Acquisitions, LLC, Roseville Acquisitions Three, LLC, and Roseville 3 Properties for approval of VACATION of certain public roadway interest in two (2), ten-foot (10’) 4 wide strips of land, comprising part of the former Mount Ridge Road that were previously deeded 5 to the applicants concurrent with the 2009 vacation of the adjacent, dedicated Mount Ridge Road 6 Right-of-Way 7 Chair Boerigter opened the Public Hearing for File 12-001 at approximately 9:20 p.m. 8 Associate Planner Bryan Lloyd briefly summarized the requested action vacating the existing roadway 9 easements that cross several of the parcels in the NE quadrant of the intersection of County Road C and 10 Cleveland Avenue. Mr. Lloyd advised that the Public Works Department staff recommended approval 11 of the proposed EASEMENT VACATION; as detailed and specifically based on Section 8 of the staff 12 report dated July 11, 2012. 13 At the request of Member Strohmeier, Mr. Lloyd reviewed the purpose of this action to clear platting of 14 rights-of-way and Ramsey County records to vacate any perceived encumbrance of the ten foot (10’) 15 strips of land already owned by Roseville Properties through previous action. Mr. Lloyd advised that 16 this formalized the City’s intent to vacate their interest. 17 City Planner Paschke advised that the previous City Attorney had determined at the time that there was 18 no need to vacate the strips and to simply deed the land back to the property owners. However, Mr. 19 Paschke advised that this served to clean up any remaining public interest for the record from that 20 original 2009 vacation. 21 At the request of Member Strohmeier, Mr. Paschke assured Commissioners that there were no planned 22 utilities and no anticipation of connecting Mount Ridge Road to County Road C, as the Prior Avenue 23 and Twin Lakes Parkway network was intended for that Twin Lakes Redevelopment Area. Mr. Paschke 24 noted that the original encumbrance, probably in 2001, had reserved the rights-of-way before 25 infrastructure had been clearly defined. 26 Chair Boerigter closed the Public Hearing for File 12-001 at approximately 9:29 p.m., with no one 27 speaking for or against. 28 MOTION 29 Member Boguszewski moved, seconded by Member Lester to recommend to the City Council 30 APPROVAL OF THE VACATION OF ALL ROADWAY INTERESTS IN THE TWO (2) 31 AREAS IDENTIFIED IN THE REQUEST; based on the comments and findings of Sections 4-6 32 and the recommendations of Section 7 of the staff report dated July 11, 2012. 33 Ayes: 6 34 Nays: 0 35 Motion carried. 36
