July 11, 2012 <br />1 <br />PLANNING FILE 12-001 <br />2 <br />Request by Roseville Acquisitions, LLC, Roseville Acquisitions Three, LLC, and Roseville <br />3 <br />Properties for approval of VACATION of certain public roadway interest in two (2), ten-foot (10’) <br />4 <br />wide strips of land, comprising part of the former Mount Ridge Road that were previously deeded <br />5 <br />to the applicants concurrent with the 2009 vacation of the adjacent, dedicated Mount Ridge Road <br />6 <br />Right-of-Way <br />7 <br />Chair Boerigter opened the Public Hearing for File 12-001 at approximately 9:20 p.m. <br />8 <br />Associate Planner Bryan Lloyd briefly summarized the requested action vacating the existing roadway <br />9 <br />easements that cross several of the parcels in the NE quadrant of the intersection of County Road C and <br />10 <br />Cleveland Avenue. Mr. Lloyd advised that the Public Works Department staff recommended approval <br />11 <br />of the proposed EASEMENT VACATION; as detailed and specifically based on Section 8 of the staff <br />12 <br />report dated July 11, 2012. <br />13 <br />At the request of Member Strohmeier, Mr. Lloyd reviewed the purpose of this action to clear platting of <br />14 <br />rights-of-way and Ramsey County records to vacate any perceived encumbrance of the ten foot (10’) <br />15 <br />strips of land already owned by Roseville Properties through previous action. Mr. Lloyd advised that <br />16 <br />this formalized the City’s intent to vacate their interest. <br />17 <br />City Planner Paschke advised that the previous City Attorney had determined at the time that there was <br />18 <br />no need to vacate the strips and to simply deed the land back to the property owners. However, Mr. <br />19 <br />Paschke advised that this served to clean up any remaining public interest for the record from that <br />20 <br />original 2009 vacation. <br />21 <br />At the request of Member Strohmeier, Mr. Paschke assured Commissioners that there were no planned <br />22 <br />utilities and no anticipation of connecting Mount Ridge Road to County Road C, as the Prior Avenue <br />23 <br />and Twin Lakes Parkway network was intended for that Twin Lakes Redevelopment Area. Mr. Paschke <br />24 <br />noted that the original encumbrance, probably in 2001, had reserved the rights-of-way before <br />25 <br />infrastructure had been clearly defined. <br />26 <br />Chair Boerigter closed the Public Hearing for File 12-001 at approximately 9:29 p.m., with no one <br />27 <br />speaking for or against. <br />28 <br />MOTION <br />29 <br />Member Boguszewski moved, seconded by Member Lester to recommend to the City Council <br />30 <br />APPROVAL OF THE VACATION OF ALL ROADWAY INTERESTS IN THE TWO (2) <br />31 <br />AREAS IDENTIFIED IN THE REQUEST; based on the comments and findings of Sections 4-6 <br />32 <br />and the recommendations of Section 7 of the staff report dated July 11, 2012. <br />33 <br />Ayes: 6 <br />34 <br />Nays: 0 <br />35 <br />Motion carried. <br />36 <br /> <br />
