Mr. Paschke reiterated that this had already been accomplished as part of the final plat approval and
113
negotiated Development Agreement for the Wal Mart site, as approved by the City Council. Mr.
114
Paschke noted that the Planning Commission nor Planning Division staff became involved in that
115
portion of the process; however, it had come up as part of the platting process and Plat review by
116
respective attorneys and acquisition proceeded, as easements were determined and State Statute
117
provisions applied to eliminate public interest as indicated. Mr. Paschke noted that, in this case, the City
118
was not actually vacating their interest, but simply clarifying actions already taken, but unclear in the
119
written documents during the title search with the Ramsey County Recorder and Assessor. Mr. Paschke
120
advised that the City no longer required any interest in retaining this property for public roadway or
121
rights-of-way purposes, since the road was now designed and completed in accordance with current
122
design for the Twin Lakes Redevelopment Area.
123
Mr. Paschke advised that this action should finally clarify all interests and clear and simplify any future
124
title searches.
125
Ayes: 6
126
Nays: 0
127
Motion carried.
128
