11, 2012 at which all persons interested in said Petition were given an opportunity to be heard <br />33 <br />prior to a unanimous vote by the Planning Commission to approve said vacation; and <br />34 <br />WHEREAS, the City of Roseville acquired fee title ownership of certain real property <br />35 <br />located in Roseville, Minnesota on which was constructed portions of Twin Lakes Parkway and <br />36 <br />Mount Ridge Road; and <br />37 <br />WHEREAS, a majority of the property owners abutting those portions of said real <br />38 <br />property legally described as follows: <br />39 <br />That part of Twin Lakes Parkway and Mount Ridge Road lying within Lot 2 <br />40 <br />Block C, TWIN VIEW, according to said plat on file and of record in the office of <br />41 <br />the County Recorder, Ramsey County, Minnesota, except the west 10 feet thereof, <br />42 <br />have filed a Petition with the City of Roseville requesting the vacation of any implied roadway <br />43 <br />interests in said real property; and <br />44 <br />WHEREAS, after two weeks published and posted notice having been given, as well as <br />45 <br />notice having been mailed to all affected property owners according to Minnesota Statutes and <br />46 <br />Roseville City Code, a public hearing was held by the Roseville Planning Commission on <br />47 <br />September 5, 2012 at which all persons interested in said Petition were given an opportunity to <br />48 <br />be heard prior to a unanimous vote by the Planning Commission to approve said vacation; and <br />49 <br />WHEREAS, the Roseville City Council has determined that it is in the best interest of the <br />50 <br />City to approve such Petitions; <br />51 <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />52 <br />ROSEVILLE, MINNESOTA: <br />53 <br />1. That the City of Roseville hereby vacates that portion of the public roadway and <br />54 <br />highway easement created by said Document No. 1511814 referred to above lying on, across and <br />55 <br />over that real property located in the City of Roseville which is legally described as follows: <br />56 <br />That part of the east 10.00 feet of Lots 6,7,8,9 and 10, Block B, TWIN VIEW, <br />57 <br />according to said plat on file and of record in the office of the County Recorder, <br />58 <br />Ramsey County, Minnesota, as described in Quit Claim Deed, Document Number <br />59 <br />1511814, recorded June 7, 1960, which lies southerly of a line drawn parallel with <br />60 <br />and distant 168.18 feet northerly of the southerly line of said Lot 7, Block B, <br />61 <br />AND <br />62 <br />That part of the west 10.00 feet of Lots 2, 3, 4, and 5, Block C, TWIN VIEW, <br />63 <br />according to said plat on file and of record in the office of the County Recorder, <br />64 <br />Ramsey County, Minnesota, as described in Quit Claim Deed, Document Number <br />65 <br />1511814, recorded June 7, 1960, which lies southerly of the easterly extension of <br />66 <br />a line drawn parallel with and distant 65.50 feet northerly of the southerly line of <br />67 <br />Lot 7, Block B of said TWIN VIEW, <br />68 <br />Page 2 of 4 <br /> <br />
