Regular City Council Meeting <br />DRA�+'T Minutes of Monday, June 18, 2047 <br />Page 34 <br />1 Further discussion ensued regarding potential continuation until the <br />2 July meeting to allow the applicant additional time to submit the re- <br />3 quested infozmation before the City Council took action; staff clarifi- <br />4 cation that the August 3, 2007 date was when the review period <br />S ended, and time needed by staff to complete their ana]yszs and prepare <br />6 recommendations and packet materials (two weeks before Council <br />7 meeting action on July 16th or July 23, 2007); appropriateness of de- <br />8 sign issues in the land use approval controls and staff s correlation of <br />9 design elements in the PUD process from the concept stage to final <br />10 plat stage; environmenta.l review considerations; and staffls clarifica- <br />11 tion that the detailed scope for the traffic study had been provided to <br />12 the applicant well over a month ago. <br />13 <br />14 Councilmember Pust reiterated her request thaf the applicant make a <br />15 determination on which option they wanted to pursue tonight: for the <br />16 application to voluntarily extend the appl'zcation; or for the Council to <br />17 vo#e to approve or deny. <br />18 <br />19 Mr. Livingston advised, in light of his time constraints with the pur- <br />20 chase agreement with the seller, he was forced to ask the City Counczl <br />21 to take a vote tonight on the project and application as presented. <br />22 <br />23 Robert Hajek, Xtra Lease, representing owner of the trucicing <br />24 site, (office address: 3433 Broadway 5treet NE, Suite 110, Min- <br />25 neapolis, MN 55413) � <br />26 Mr. Hajek provided a brief review of this site's history related to <br />27 threats o£ condemnation and uliimate and unprecedented withdrawal <br />28 of condemnation proceedings by the City; the moratorium imposed by <br />29 the City; Xtra Lease's desire, as a naiional and international company, <br />30 to be a good neighbor in Roseville; status of the Ramsey County Dis- <br />31 trict Court Order related to studies comple�ed on the Twin Lakes area <br />32 properties; current dispute in court regarding surety bonds between <br />33 the City and Twin Lakes LLC; and other issues in attempting to pro- <br />34 ceed wifli this development. <br />35 <br />36 Mr. Hajek advised thai Xtra Lease had been patient and had held this <br />37 land for years as it awaited resolution ta the above issues; howevex, he <br />38 advised that they will not continue to do so; and if necessary, would <br />39 rreturn to storing t:rucks on the property through completion of a long- <br />
