Pubiic Improvements. New storm sewer, sanitary sewer, water and stree� <br />projects are constructed and financed under a section of the state statutes <br />referred to as the "Local Improvement Code". The stat�tory process for <br />initiating and comp7et�ng a project under this code �s summarized below. <br />7. Initiation of Project. Improvement projects can be initiated in one <br />o two ways: by petition, or by Cauncil action. Upon receipt of a <br />petition representing more than 35q of all affected property awners, <br />t�e Council, under state law, must direct the staff to undertake a <br />feasi6ility study. <br />2. Feasibil�it S_�tu�d �. Upon direction of the City Cou�cil, the staff <br />prepares a s-- tu ycTto determine if the projec� is technically feasible, <br />prepares pre7iminary designs, determ�nes estimated casts, and id�ntifies <br />those property owners to be assessed. Upon completion of the study, the <br />Council reviews and formally accepts the study. In addition, the Gounci7, <br />at that time, establishes a date for the public hearing to consider the <br />project. If, though, the praject is 100� pet�tioned for, the Council <br />if it chooses, may elect not holding a pubiic hearing and may direct the <br />staff to prepare final plans. <br />3. Public Hearin�. After the public hearin� is established, the staff <br />maiis notices ta a11 af�ected praperty owners informing them of the date <br />of the hearing and a brief descriptian of the project. At the hearing, <br />the Council receives a repart from the Pubiic Works Director, the <br />financial consultant, and liste�s to comments or concerns fram the <br />praperty owners. After appropriate deliberation, a 3/5th vate by the <br />Council is required to initiate the project. (A project initiated by <br />the Council or on a petition af less than 35% requires a 4/5th vote <br />for approval). If the Council elec�s nat to continue with �he project, <br />the improvement is dropped. <br />4. Pre aration of Plans. If the Counc9l approves the praject, the staff <br />is a so instructe ta prepare detai7ed p7ans and to accept bids on the <br />praject. Upon campletian of �he plans, wliich are mailed to requesting <br />contractors, sealed bids are accepted and received by the staff <br />5. Awardfng Bids. Follaw�ng review of the bids, the Council takes �ormal <br />action to award the contract to the Iowest qualif�ed bidder. <br />6. Constructio�. After the b9d is awarded, construction is initiated. <br />ur7ng t e cons�ruction process, the Council is asked to author�ze pay- <br />ments as the work praceeds. When the project �s connleted and it is <br />found acceptabie by the staff, the Council a�thorizes fina1 payment to <br />the cantractor and the project is considered completed. <br />7. Assessment Rolls. In the fa17 fo7lowing completion af the project, <br />t e Caunci aut orizes the staff to prepare assessment ro11s �or al1 <br />pubiic improvement projects completed dur�ng the past year. At a <br />subsequent meeting, the Council accepts the rolls and establishes a <br />date for a public hearing. <br />8. Assessment Hearin . All affected property owners are again notified <br />t at Counci wi be hoTding an assessment hearing. At the heari�g <br />citizens have an opportunity ta question or request modification in <br />their assessment costs. The Co�ncil then adapts the assessment roll <br />with or without modifications and directs that they be certified to <br />the County Assessor for coTlection. <br />-34- <br />
