I� has not done maintena.nca on the <br />service from this main sewer to buildings, even in that partion of the service <br />that is withzn the right-af-way or easement cantrolled by the village. This <br />procedure is speZled out zn the Village Code zn S�ction 7?.190 Pazt 7I and <br />reads as foZiows: <br />"It sha21 be the responsibility oi the owner or occupan� to snaintain <br />the sewer sezvice from the main.sewer to the house or buildzng." <br />This procedure has been done for many years and in general has proven satis- <br />factoxy, botti in Roseville and throughou� the na�ion. There are, however, <br />instances where this creates a hardshi.p on the property owner because ot <br />expenses incurxed to repa.ir damaged sewer sex-vices in the right-o£-way which <br />occurred thraugh Vz.Ilage :.neglz�ence. The Viilage recognzzes this hardship <br />and is establishing this policy to deal with it. <br />The property owner shouid contact the contractor of his/her choice who zs <br />licensed to do such waxk in the Village, ta]ce out the necessary permits, have <br />the work inspected as usual. The exception to this being that the contractor <br />should be specificall.y informed that he is to cantact the Village just before <br />uncoverin� the Iead �rom the main at the suspected point of the probl�m and <br />have a.ri inspector there at the t�me the pipe is exposed. This will afford the <br />Vi2lage the opportunity to get first-hand in£ormation as to the cause of the <br />p�oblem and to make a determination as t� whe�her this problem tvas the result <br />of the Vi2lage negligencc in any manner_ If it was determined hy the inspector <br />that indeed the Vi�lage was negligent in regard to this serv�.ce from the main <br />to the point of connec�ion to the lead from the house, then the Village wi11 <br />assume the expense o� correctino this problem. This assumed liabi,lity, however, <br />is to be iimzted to the expenses zncurred in this particular instance. It should <br />be� made clear that if the Village i.nspector is not there at ttte time of the pz�y� <br />exposure and the problem certifi.catiion,that the Vi3lage will not pay for the <br />expenses regardless of the clai.med conditions. <br />I� there axe any unresolved pxoblems ar questions relating to <br />contact me and I wz1l be happy to revzew the procedure.
