<br />CITY of ROSEVILLE <br />ORDINANCE NO. _____ 1 <br />AN ORDINANCE REPEALING CHAPTER 1 022 OF TITLE 10 ZONING ORDINANCE 2 <br />OF THE ROSEVILLE CITY CODE 3 <br />THE CITY OF ROSEVILLE ORDAINS: 4 <br />SECTION 1. Purpose: The Roseville City Code is hereby amended to eliminate in total 5 <br />Chapter 1022, Zoning Overlay District Twin La kes based on decision of the Ramsey County 6 <br />District Court, March 28, 2012 whereby Ordina nce 1417 was determined to be invalid and 7 <br />unenforceable and therefore Chapter 1022, Overlay Di strict Twin Lakes is deemed the same. 8 <br /> 9 <br /> SECTION 2 : Chapter 1022 is hereby repealed as follows: 10 <br /> 11 <br />1022.01: Intent and Purpose 12 <br />1022.02: Definitions 13 <br />1022.03: Infrastructure Requirements and Standards 14 <br />1022.04: General Requirements and Standards 15 <br />1022.05: Permits and Approvals 16 <br />1022.06: Applicability of Other Ci ty Ordinances and Policies 17 <br />1022.07: Consideration of Applications for De velopment Within the Twin Lakes Overlay 18 <br /> District 19 <br />1022.08: Severability 20 <br /> 21 <br />1022.01: INTENT AND PURPOSE 22 <br />The City of Roseville has determ ined that it is necessary, for th e purpose of promoting the public 23 <br />health, safety, morals and general welfare of th e City to redevelop the area within the City 24 <br />known as the Twin Lakes Redevelopment Area. In order to carry out such redevelopment the 25 <br />City has conducted an Alterna tive Urban Areawide Review (“AUAR”) for the Twin Lakes 26 <br />Redevelopment Area. The AUAR identifies va rious environmental, roadway and utility 27 <br />improvements which are necessary in the Twin Lakes Redevelopment Area in order for the area 28 <br />to be redeveloped. The AUAR contains a mitig ation plan which requires, among other things, 29 <br />the construction of roadway and utility improve ments and environmental mitigation within the 30 <br />Twin Lakes Redevelopment Area. While the City desires to promote the redevelopment of the 31 <br />Twin Lakes Redevelopment Area, it does not have the financial resources necessary to construct 32 <br />the infrastructure and perform the environmen tal remediation required under the AUAR. For 33 <br />this reason, the City has determined that de velopment limitations n eed to be placed upon 34 <br />property within the Twin Lakes Redevelopment Area until adequate infrastructure can be 35 <br />constructed and environmental and other mitigation described in the AUAR performed. 36 <br />Therefore, to promote the redevelopment of the Twin Lakes Redevelopment Area, the Twin 37 <br />Lakes Overlay District is established and all pr operty within the District is subject to the 38 <br />provisions of this Chapter. 39 <br />40
