Mr. Lloyd <br />97 <br />advised that this had been confirmed by the 4,600 square feet of land included in the plat; <br />98 <br />with a portion of the parcel purchased by the City from the property owner in 2009, and <br />99 <br />now being sold back to the property owner at market value. Mr. Lloyd noted that these <br />100 <br />transactions had been previously reviewed by the Planning Commission in February <br />101 <br />when the plat application was discussed and disposal of land approved. <br />102 <br />Applicant <br />103 <br />Representatives of the applicant were present, but had no comment beyond staff’s <br />104 <br />presentation. <br />105 <br />Public Comments <br />106 <br />No one appeared to speak for or against. <br />107 <br />Vice Chair Gisselquist closed the Public Hearing for File 12-001 at approximately <br />108 <br />6:55p.m., with no one appearing for or against. <br />109 <br />MOTION <br />110 <br />Member Olsen moved, seconded by Member Lester to recommend to the City <br />111 <br />Council APPROVAL of the VACATION of all roadway interests in the area identified <br />112 <br />in the request; based on the comments and findings of Sections 4-6; and the <br />113 <br />recommendation of Section 7 of the report dated September 5, 2012. <br /> <br />114 <br />Member Strohmeier questioned if there was a mechanism for the City to sell the land <br />115 <br />outright, rather than vacating it. <br />116 <br />Mr. Paschke reiterated that this had already been accomplished as part of the final plat <br />117 <br />approval and negotiated Development Agreement for the Wal Mart site, as approved by <br />118 <br />the City Council. Mr. Paschke noted that the Planning Commission nor Planning Division <br />119 <br />staff became involved in that portion of the process; however, it had come up as part of <br />120 <br />the platting process and Plat review by respective attorneys and acquisition proceeded, <br />121 <br />as easements were determined and State Statute provisions applied to eliminate public <br />122 <br />interest as indicated. Mr. Paschke noted that, in this case, the City was not actually <br />123 <br />vacating their interest, but simply clarifying actions already taken, but unclear in the <br />124 <br />written documents during the title search with the Ramsey County Recorder and <br />125 <br />Assessor. Mr. Paschke advised that the City no longer required any interest in retaining <br />126 <br />this property for public roadway or rights-of-way purposes, since the road was now <br />127 <br />designed and completed in accordance with current design for the Twin Lakes <br />128 <br />Redevelopment Area. <br />129 <br />Mr. Paschke advised that this action should finally clarify all interests and clear and <br />130 <br />simplify any future title searches. <br />131 <br />Ayes: 6 <br />132 <br />Nays: 0 <br />133 <br />Motion carried. <br />134 <br />Staff advised that anticipated City Council action is scheduled for September 24, 2012. <br />135 <br />b. PLANNING FILE 12-0130 <br />136 <br />Request by Meritex Enterprises, Inc. for approval of a PRELIMINARY PLAT of the <br />137 <br />land currently addressed as 2280 Walnut Street <br />138 <br />Vice Chair Gisselquist opened the Public Hearing for File 12-001 at approximately 6:58 <br />139 <br />p.m. <br />140 <br />Associate Planner Lloyd summarized the request of Meritex Enterprises to plat Outlot A <br />141 <br />of the Highcrest Park Second Addition Plat lying immediately south and east of the <br />142 <br />intersection of Walnut Street and Terminal Road. Staff recommended approval of the <br />143 <br />proposed PRELIMINARY PLAT, pursuant to City Code, Title 11 (Subdivisions); based on <br />144 <br />the comments and findings of Sections 4-5 and the recommendation of Section of the <br />145 <br />staff report dated September 5, 2012. <br />146 <br /> <br />
