Regular Planning Commission Meeting
Minutes – Wednesday, July 11, 2012
Page 3
interests on land it currently owned until it was clearly determined that the property was
96
not needed for any public purpose, and would be included in the final plat. Mr. Lloyd
97
advised that this had been confirmed by the 4,600 square feet of land included in the plat;
98
with a portion of the parcel purchased by the City from the property owner in 2009, and
99
now being sold back to the property owner at market value. Mr. Lloyd noted that these
100
transactions had been previously reviewed by the Planning Commission in February
101
when the plat application was discussed and disposal of land approved.
102
Applicant
103
Representatives of the applicant were present, but had no comment beyond staff’s
104
presentation.
105
Public Comments
106
No one appeared to speak for or against.
107
Vice Chair Gisselquist closed the Public Hearing for File 12-001 at approximately
108
6:55p.m., with no one appearing for or against.
109
MOTION
110
Member Olsen moved, seconded by Member Lester to recommend to the City
111
Council APPROVAL of the VACATION of all roadway interests in the area identified
112
in the request; based on the comments and findings of Sections 4-6; and the
113
recommendation of Section 7 of the report dated September 5, 2012.

114
Member Strohmeier questioned if there was a mechanism for the City to sell the land
115
outright, rather than vacating it.
116
Mr. Paschke reiterated that this had already been accomplished as part of the final plat
117
approval and negotiated Development Agreement for the Wal Mart site, as approved by
118
the City Council. Mr. Paschke noted that the Planning Commission nor Planning Division
119
staff became involved in that portion of the process; however, it had come up as part of
120
the platting process and Plat review by respective attorneys and acquisition proceeded,
121
as easements were determined and State Statute provisions applied to eliminate public
122
interest as indicated. Mr. Paschke noted that, in this case, the City was not actually
123
vacating their interest, but simply clarifying actions already taken, but unclear in the
124
written documents during the title search with the Ramsey County Recorder and
125
Assessor. Mr. Paschke advised that the City no longer required any interest in retaining
126
this property for public roadway or rights-of-way purposes, since the road was now
127
designed and completed in accordance with current design for the Twin Lakes
128
Redevelopment Area.
129
Mr. Paschke advised that this action should finally clarify all interests and clear and
130
simplify any future title searches.
131
Ayes: 6
132
Nays: 0
133
Motion carried.
134
Staff advised that anticipated City Council action is scheduled for September 24, 2012.
135
b. PLANNING FILE 12-0130
136
Request by Meritex Enterprises, Inc. for approval of a PRELIMINARY PLAT of the
137
land currently addressed as 2280 Walnut Street
138
Vice Chair Gisselquist opened the Public Hearing for File 12-001 at approximately 6:58
139
p.m.
140
Associate Planner Lloyd summarized the request of Meritex Enterprises to plat Outlot A
141
of the Highcrest Park Second Addition Plat lying immediately south and east of the
142
intersection of Walnut Street and Terminal Road. Staff recommended approval of the
143
proposed PRELIMINARY PLAT, pursuant to City Code, Title 11 (Subdivisions); based on
144
the comments and findings of Sections 4-5 and the recommendation of Section of the
145
staff report dated September 5, 2012.
146
