<br />4. The City has determined that the three parcels of property described in paragraphs 1 and 2 <br />herein, are parcels of unimproved property within the meaning of Minn. Stat. §429.061. <br />The City has determined that "unimproved property" means property that is not benefited <br />in its present use, but when the use of the property is converted to a use that will benefit, <br />then the property becomes improved. <br /> <br />5. If property is sold, PIK Terminal will promptly notify the City of sale. <br /> <br />6. The deferred amounts will become payable when the City determines that the use has <br />changed and benefits from the improvements and/or if the property is sold and the City <br />adopts a resolution to that effect and files same with the proper offices of Ramsey County. <br />The City will not adopt a resolution determining when the deferred amount shall be <br />payable without giving mailed notice not less than 30 days nor more than 60 days to PIK <br />Terminal and Eugene and Delores Pikovsky of the meeting which has on its agenda, the <br />proposed resolution. <br /> <br />Notices of any future council meeting which have these assessments on the agenda will be <br />sent to PIK Terminal and Eugene and Delores Pikovsky. The notices referred to in this <br />paragraph will be mailed to the following addresses: <br /> <br />PIK Terminal Company <br />P.O. Box 390565 <br />Minneapolis, MN 55439-0565 <br /> <br />Eugene and Delores Pikovsky <br />c/o PIK Travel <br />2725 Lincoln Drive <br />St. Paul, MN 55113 <br /> <br />IfPIK Terminal or Eugene and Delores Pikovsky want the notices to be sent to different <br />addresses, they may provide the City with those addresses. <br /> <br />7. Interest on the amount due will be as follows: <br /> <br />a) On the Amended Assessment - Interest at the rate of7.5% per annum accruing on <br />the full amount of the amended assessment will commence on August 22, 1997. <br /> <br />b) Interest on the Deferred Assessment - Interest at the rate of 7.5% per annum will <br />commence 30 days after the City adopts the resolution as set forth in paragraph 6 <br />above, determining when the deferred assessment shall become payable. <br /> <br />8. In no event will any assessment or any installment be due after the calendar year of2025. <br /> <br />9. All other portions of Resolutions No. 9436 shall remain in force and effect unless <br />specifically amended or inconsistent with this Resolution. <br /> <br />2 <br />
