��� <br />� <br />REQUEST FOR COUNCIL ACTION <br />Department Approval <br />�. <br />Date: 1/28/13 <br />Item No.: 7.n <br />City Manager Approval <br />Item Description: Approve a Resolution Regarding the Public Improvements Associated <br />with Applewood Pointe of Langton Lake and Applewood Pointe of <br />Langton Lake Second Addition <br />BACKGROUND <br />APPLEWOOD POINT OF LANGTON LAKE and APPLEWOOD POINTE OF LANGTON <br />LAKE SECOND ADDITION plats were created by United Properties to redevelop land located <br />at 2990, 2996 and 3010 Cleveland Avenue North. The approvals were to construct a 89 unit <br />senior cooperative building and an 93unit assisted living facility. The development was first <br />approved in 2007 as a Planned Unit Development; construction of the first phase of the <br />residential began in 2010 and was completed in 20ll . <br />The Developer is moving ahead with the final phase of the Applewood Pointe at Langton Lalce <br />senior cooperative residence. There are a few items that need to be completed to facilitate the <br />successful completion of the final phase of this redevelopment. These are: <br />• Accept the original improvements constructed for APPLEWOOD POINTE OF LANGTON <br />LAKE. <br />On February 14, 2011, the City Council approved a public improvement contract with United <br />Properties. The APPLEWOOD POINTE OF LANGTON LAKE plat was the construction of <br />a 93-unit, senior cooperative residence at 2990 and 2996 Cleveland Avenue North. The <br />senior cooperative residence was proposed to be constructed in two phases. As a part of the <br />development of the first phase United Properties constructed a public pathway, Langton Lake <br />Drive, watermain, sanitary sewer, streetlights, and storm sewer improvements. <br />The City worked with their Engineer during construction to ensure the improvements were <br />installed according to approved plans and City specifications. The work described in the <br />original agreement was completed in 2012. <br />• Vacate the drainage and utility easement dedicated on the APPLEWOOD POINTE OF <br />LANGTON LAKE SECOND ADDITION plat for the temporary pond. <br />A temporary drainage pond located to the northeast of the cooperative building first phase <br />was constructed as a part of the APPLEWOOD POINTE OF LANGTON LAKE public <br />improvements. This pond was intended to provide for the drainage needs of the first phase of <br />the cooperative residence and the adjacent assisted living facility, until a permanent drainage <br />facility and easement could be established with the completion of the second phase of the <br />cooperative residential development. <br />On November 19, 2012, the City Council approved the vacation of the drainage and utility <br />easement that was dedicated on Lot 2, Block 1 of APPLEWOOD POINTE OF LANGTON <br />Page 1 of 3 <br />
