LAKE SECOND ADDITION. <br />• Approve a new Public Improvement Contract to cover the construction of the new storm <br />., sewer pond and underground treatment facility. <br />The Developer has worked with the City and Rice Creek Watershed District on new storm <br />� water facilities and would lilce to proceed with construction. These new facilities will be <br />public. A new drainage and utility easement has been dedicated over the new storm sewer. <br />In order to ensure that the improvements are built to City standards, we have drafted a Public <br />� Improvement Contract that defines the responsibilities involved with the proposed public <br />� improvements. The improvements must meet all applicable City Standards for the <br />construction. <br />- • Amend the Public Improvement Easement and Maintenance Agreement to include the new <br />facilities. <br />�� On February 14, 2011, the City Council approved a Public Improvement Easement and <br />Maintenance Agreement. This agreement defines the future maintenance responsibilities for <br />the improvements to the site. The modification of the storm sewer design requires an <br />amendment to this agreement. <br />POLICY OBJECTIVE <br />- The process described in this memo and the subsequent documents have been reviewed by the <br />r� City Attorney. <br />The following steps have been completed in accordance with City Policy to finalize the <br />construction of the public improvements for APPLEWOOD POINT OF LANGTON LAKE- <br />Phase 1: <br />• Certification from the civil engineer in charge of the project verifying that all work has been <br />completed in accordance with the approved plans and specifications. <br />• A resolution by the City Council accepting the project and beginning the two-year warranty <br />period. <br />: FINANCIAL IMPACTS <br />� All costs associated with construction of the public improvements necessary for this development <br />are borne by the Developer. <br />E�� For the APPLEWOOD POINT OF LANGTON LAKE- Phase 2 Public Improvement Contract, a <br />$5,338 City Coordination fee is required. Appropriate surety will be provided for all public <br />improvements in the amount of 125% of the construction cost, for a total of $166,638.00. Once the <br />construction of the improvements has been completed and accepted by the City, this surety will be <br />F� released. Since this was a developer initiated project, the City will not participate in the cost to <br />s: � construct these public improvements. <br />As described in the Planned Unit Development Agreement, the remaining parlc dedication fee, <br />$82,000, will be collected far the 41 units being constructed as a part of Phase 2. <br />STAFF RECOMMENDATION <br />All necessary items have been completed in accordance with project plans and specifications for <br />the public improvements constructed for APPLEWOOD POINT OF LANGTON LAKE- Phase <br />Page 2 of 3 <br />
