CITY OF ROSEVILLE, MINNESOTA <br />PETITION FOR P[TBLIC IMPROVEMENT <br />To the City Council of Roseville, Minnesota: <br />We, the undersigncd owners ("Petitioner(s)") of the real property legally described in <br />Exhibit A attached hereto ("Property"), hereby petition the Roseville City Council to: a} <br />construct the improvements shown and described in Exhibit B attachcd hereto (thc <br />"Improvement(s)") to service the Property, and b) assess ihe entire cost of said Impravement(s), <br />pursuant to Minnesota Statutes, Chapter 429, against the Property (ihe "Public Improvemenl <br />Project"). <br />Tn order to process this petition, the Petitioner(s) re�uest that the City Council order the <br />preparation of a Feasibility Report in which the estimated costs of the Improvement(s) will be <br />determined. The Petitioner(s} understand that upon receipt of this petition and the prcparation of <br />the Feasibility Study, a public hearing will be held at which time the Petitioner(s) may voice <br />their support or opposition of the Public Improvement Project based upori the costs as <br />determincd in the Feasibility Report. If this petition is dcnicd at the public hearing, the <br />Petitioner(s} agrec to pay all costs, including but not limited to the preparation of the Feasibility <br />Study and the costs of holding a Public Improvement Hearing, incurred by the City. <br />The Pctitioner(s) understand that if this petition is approved at the Public Hcaring, thc <br />Petitioner(s) sha11 be required to agree to and sign a written Request and Waiver, in the form <br />promulgated by the City, whereby the Petitioner(s}; a) request the City to proceed with fhe Public <br />Irnprovement Project, b) agree to have the entire cost of the Project assessed against the <br />Property, and c) waive all rights to appeal the assessments, before the City will proceed further <br />with the Public Irnprovement Project. If the Request and Waiver is not signed by all of the <br />Petitioner{s}, the City shall not proceed with the Public Improvement Project. <br />The Petitioner(s} furtlier understand that the City intends to proceed with the Public <br />Improvement Project using a procedure whereby thc City will not proceed with the construction <br />of the Irnprovement(s) until after certification of the Assessment Roll and expiration of the 30 <br />day appeal period following the certification of the assessments. In the event the City does not <br />eommence construction of the Improvement(s), the Petirioner{s) agree to pay all eosts incurred <br />by the City prior to the date of the Assessment Hearing, including but not limited to the <br />preparation of the Feasibility Study, the preparation of Plans and Specifieations; the cost of <br />advertising far opening and accepting or rejecting bids; the preparation of the Assessment Roll; <br />and the cost of holding the Public Improvement and Assessment Hearings. <br />Concurrently with the dclivery of this petition, the Petitioner(s) hereby furnish and <br />deliver to the City a cash deposit in the amount of $1,500 to guarantee payment for all costs <br />incurred by the City of Roseville prior ta the Assessment Hearing, including but not limited to <br />thc prepara�ion of the Feasibility Study; the preparation of Plans and Specifications; the cost of <br />advertising for, opening, and accepting or rejecting bids; the preparation of an Assessment Roll; <br />1 <br />
