or validity of the assessments or the procedures used by the City in levying the <br />assessments for said Improvement(s), and hereby release the City, its mayor, <br />councilmembers, employees, agents and contractors, from any and all liability related to <br />or arising out of the levying of said assessments and the Project. <br />6. The Petitioner(s) agree to pay all costs incurred by the City in the event the <br />Improvement(s) are not constructed or the Project is terminated, including but not limited <br />to the preparation of the Feasibility Study; the preparation of the Plans and <br />Specifications; the cost of advertising for, opening and accepting bids; the preparation of <br />an Assessment Roll; and the cost of holding the Public Improvement and Assessment <br />Hearings. All financial obligations of the Petitioner(s) hereunder shall be joint and <br />several. <br />7. The terms and provisions hereof shall inure to the benefit of the City of Roseville and <br />shall be binding upon the Petitioner(s) and their respective heirs, representatives, <br />successors and assigns, and all future owners of all or any part of the above described <br />property, and shall be deemed to be covenants running with the land. <br />IN WITNESS WHEREOF, the undersigned have signed this agreement as of the <br />day of , 2012. <br />� <br />
