REQUEST AND WAIVER <br />WHEREAS, the Roseville City Council has received a Petition from the undersigned <br />property owners ("Petitioner(s)") to construct improvements and assess the cost thereof, pursuant <br />to Minnesota Statutes, Chapter 429, against the property legally described in Exhibit A attached <br />hereto ("Property"); and <br />WHEREAS, the improvement(s) to be constructed (which are described in Exhibit B <br />attached hereto and referred to herein as the ("Improvement(s)") and the assessment proceedings <br />associated therewith have been identified by the City as follows: <br />("Project"); and <br />WHEREAS, the City has obtained a Feasibility Study in connection with the Project <br />which has been reviewed by the Petitioner(s); and <br />WHEREAS, the City has determined the estimated cost of the Project to be <br />$ ; and <br />WHEREAS, having reviewed the Feasibility Study and found the estimated cost of the <br />Project to be fair and reasonable, the Petitioner(s) desire that the City proceed with the Project <br />and assess the entire cost thereof against the Property; <br />NOW THEREFORE, in consideration of the City proceeding with the Project and <br />assessing the entire cost against the Property, the Petitioner(s) request and agree as follows: <br />1. The Petitioner(s) hereby request that the City proceed with the construction of the <br />Improvement(s) and the assessment of the entire cost thereof against the Property <br />pursuant to Minnesota Statutes, Chapter 429. <br />2. The Petitioner(s) agree to pay the entire cost of the assessments estimated to be <br />$ , apportioned in the manner set farth in Exhibit C, spread over a <br />period of years. <br />3. The Petitioner(s) agree that the foregoing estimated assessment amount may be exceeded <br />if the increases are a result of requests made by the Petitioner(s) or are otherwise <br />approved by the Petitioner(s) in a subsequent separate written document. <br />4. The Petitioner(s) expressly waive any objection to any irregularity with regard to said <br />assessment proceedings and any claim that the amount thereof levied against the <br />Petitioner(s) property is excessive, so long as the assessments amount does not exceed the <br />estimated assessment amount set forth in Provision 2 above plus any increases made <br />thereto pursuant to Provision 3 above. <br />5. The Petitioner(s) hereby waive all rights which they have by virtue of Minnesota Statutes, <br />Chapter 429.081 to appeal the assessment in court or otherwise to challenge the amount <br />
