Regular City Council Meeting <br /> Monday, May 20, 2013 <br /> Page 25 <br /> Mayor Roe stated that the City Council had to consider applications before it un- <br /> der code currently in place; and noted similar concerns raised during past subdivi- <br /> sion applications, opining that this was not new ground being covered with this <br /> approval; however, it raised issues that needed further review as part of the ap- <br /> proval process. <br /> Roll Call <br /> Ayes: Willmus; Laliberte; and Roe. <br /> Nays: McGehee. <br /> Motion Carried. <br /> At the request of Mayor Roe, City Attorney Gaughan confirmed that a super ma- <br /> jority vote was not required for this approval. <br /> Mayor Roe expressed the City Council's appreciation of the neighbors' attend- <br /> ance and comments; and further expressed appreciation for their feedback. <br /> b. Authorize Presumptive Penalty for Szechuan Restaurant Alcohol Compli- <br /> ance Failure <br /> Roseville Police Lt. Lorne Rosand briefly summarized the alcohol compliance <br /> failure of Szechuan Restaurant as detailed in the RCA dated May 20, 2013; and <br /> provided background and training information. For the benefit of new Coun- <br /> cilmembers, Lt. Rosand displayed a sample driver's license for someone under <br /> the age of twenty-one; and reviewed the process followed during compliance <br /> checks. Lt. Rosand recommended the mandatory minimum penalty of$1,000 fine <br /> and a one day suspension as set forth in Section 302.15 of Roseville City Code. <br /> Owner of restaurant—Jesse H. Wong, Owner of Szechuan Restaurant <br /> Ms. Wong expressed her sorrow in this failure, and assured Councilmembers that <br /> it wouldn't happen again, as she had reinforced with her employees for checking <br /> identification. <br /> Lt. Rosand confirmed that all training records were found in order and done on <br /> time. <br /> Willmus moved, Laliberte seconded, authorizing the Roseville Police Department <br /> to issue and administer the mandatory minimum penalty of$1,000 fine and a one <br /> day suspension, as set forth in Section 302.15 of Roseville City Code. <br /> Councilmember Willmus thanked Ms. Wong for coming tonight; and appreciated <br /> her taking this matter seriously, in accordance with how serious the City Council <br /> took these matters and recent efforts to enforce that concern of sales to minors, <br /> and their firm stance. <br /> Roll Call <br />
