4.0B <br />ACKGROUND <br />Because this request is initiated by the City rather than by an outside applicant, the State- <br />mandated 60-day timeline does not apply in this case; this is noted merely to explain the <br />“n/a” (i.e., not applicable) notation in the Application Review Details section above. <br />5.0PZTC <br />ROPOSEDONINGEXT HANGES <br />The proposed zoning text changes are comprised within the draft ordinance included with <br />bold <br />this report as Attachment B; proposed insertions will be represented in text, and <br />proposed deletions will be shown in strikethrough text. A brief discussion of the <br />proposed changes can be found in the paragraphs below. <br />5.1Motor vehicle repair is identified in Table 1006-1, the table of uses pertaining to the <br />Employment Districts, as a permitted use in the Industrial zoning district. Although <br />Planning Division staff believes that the zoning code does not intend to limit such repair <br />to smaller vehicles, the definition of “Motor vehicle repair” in §1001.10 (Definitions) <br />imposes a limit which is equivalent to the size of large pickup trucks (e.g., Ford F350 or <br />GMC Sierra 3500). This size limit makes sense in other zoning districts (e.g., Community <br />Business and Regional Business) where motor vehicle repair is allowed, but Planning <br />Division staff doesn’t believe that any particular size limit is necessary in the Industrial <br />District. <br />5.2The proposed amendment to Table 1006-1 changes the pertinent table entry by modifying <br />the name of the land use and by eliminating the “Y” in the “Standards” column of the <br />table. (The “Y” directs the reader to another section of the zoning code for specific <br />standards pertaining to the use, but no such standards exist, nor does Planning Division <br />staff feel that any particular standards are necessary.) While the original notion for this <br /> only involved an amendment to the Industrial District, Planning <br />ZONING TEXT CHANGE <br />Division staff also proposes to add “Motor vehicle repair, large” to the zoning code’s <br />definitions. <br />6.0PC <br />UBLICOMMENT <br />The duly-noticed public hearing for the proposed was held by the <br />ZONING TEXT CHANGE <br />Planning Commission on May 1, 2013, after which the Planning Commission voted <br />unanimously (i.e., 7 – 0) to recommend approval of the proposal; draft minutes of the <br />public hearing are included with this report as Attachment B.
