Minnesota State Statutes 462.357, Subd. 4. Amendments, <br /> states the following: <br />57 <br />An amendment to a zoning ordinance may be initiated by the governing body, the <br />58 <br />planning agency, or by petition of affected property owners as defined in the <br />59 <br />zoning ordinance. An amendment not initiated by the planning agency shall be <br />60 <br />referred to the planning agency, if there is one, for study and report and may not <br />61 <br />be acted upon by the governing body until it has received the recommendation of <br />62 <br />the planning agency on the proposed amendment or until 60 days have elapsed <br />63 <br />from the date of reference of the amendment without a report by the planning <br />64 <br />agency. <br />65 <br />2.0SR/R <br />TAFF EVIEWECOMMENDATION <br />66 <br />The Planning Division, after consulting with the City Attorney, reviewed the <br />67 <br />current language in the Purpose statement and State Statutes and crafted an <br />68 <br />amendment that clarifies those individuals and or governmental entities that are <br />69 <br />permitted to initiate zoning test and/or map amendments. The City Attorney has <br />70 <br />reviewed and supports the language correction. <br />71 <br />The Roseville Planning Division recommends consideration of the following <br />72 <br />modification to clarify the text and/or map amendment initiation process: <br />73 <br />Purpose <br />: An owner of property within Roseville, including the City Council, may <br />74 <br />wish to amend the text of the zoning regulations pertaining to his or her property <br />75 <br />or to amend the pertinent zoning district designation on his or her property as <br />76 <br />Amendment: <br />shown on the Official Zoning Map. An amendment to a Zoning <br />77 <br />Ordinance or map (“Official Zoning Map”) may be initiated by the governing <br />78 <br />body (City Council), the planning agency (including the Community <br />79 <br />Development Department), a property owner, or by petition of affected property <br />80 <br />owners as defined in the City’s Zoning Ordinance.
