Councilmember <br /> Laliberte asked that staff also be sensitive to all of the customers it served. <br /> Council Role/Zoning and Flexibility <br /> Councilmember McGehee opined that the City Council needed to make sure it <br /> was not put in a position to be a corner due to the rigidity of its ordinance; opining <br /> that it had a role in mediation. Councilmember McGehee recognized that if those <br /> rules became too flexible, it would create additional problems. <br /> Councilmember McGehee referenced a previous letter from City Attorney Bar- <br /> tholdi written to the City Council indicating that there was a conflict between the <br /> Regional and Community Business Zoning Districts due to an overlap in defini- <br /> tions and their ambiguity, potentially setting up the City for further lawsuits. <br /> Councilmember McGehee noted the need to be flexible without ambiguity; allow- <br /> ing the City to be open to new ideas while not also being open to lawsuits. <br /> Councilmember McGehee reiterated her often-stated position and support for <br /> Planned Unit Developments (PUD's) to be part of the system, allowing a place for <br /> the City Council and its residents to have a significant role. As an example, <br /> Councilmember McGehee noted the recent CDI presentation for the Dale Street <br /> project for single-family bungalow arrangements on small lots each privately <br /> owned with common space. Councilmember McGehee opined that the City <br /> didn't have any zoning like that. <br /> Mayor Roe corrected Councilmember McGehee that there was zoning that al- <br /> lowed for that. <br /> Mr. Trudgeon concurred, noting that allowances were in code for courtyard set- <br /> ups; and that concept had been illustrated as allowable in code. <br /> Councilmember McGehee clarified that the City should be willing to accommo- <br /> date any idea coming forward that seemed to be a good idea. <br /> Mayor Roe noted that they all needed to proceed through the process to determine <br /> their merits on a case-by-case basis. <br /> Mayor Roe asked that City Attorney Bartholdi correct any characterizations of the <br /> letter referenced by Councilmember McGehee between him and the City Attor- <br /> ney; opining that his interpretation didn't match entirely with that of Coun- <br /> cilmember McGehee. <br /> City Attorney Bartholdi apologized that he didn't exactly remember the letter be- <br /> ing referenced, and would need to review it again. However, Mr. Bartholdi ad- <br /> vised that he recalled that it had addressed a procedural issue, with his opinion <br /> differing from that of Mr. Trudgeon and the decision made by the Community <br />
