4.0B <br />ACKGROUND <br />15 <br />When the Planning Division and its consultant developed the design standards for <br />16 <br />the Commercial and Mixed-Use Districts during the Zoning Ordinance update, <br />17 <br />there was discussion and debate of certain sub-uses and whether greater flexibility <br />18 <br />should be offered. One area (in two separate code sections) proving to be a <br />19 <br />challenge is the treatment of drive-through facilities and refuse enclosures, <br />20 <br />specifically their proximity to an adjacent street and the fact that the current <br />21 <br />requirements do not always lead to aesthetically pleasing designs. <br />22 <br />Below are the specific standards: <br />23 <br />1005.02.I: Design Standards <br />Section reads as follows: <br />24 <br />Garages Doors and Loading Docks: <br />I.Loading docks, refuse, recyclables, <br />25 <br />and/or compactors shall be located on rear or side facades and, to the extent <br />26 <br />feasible, garage doors should be similarly located. Garage doors of attached <br />27 <br />garages on a building front shall not exceed 50% of the total length of the <br />28 <br />building front. Where loading docks, refuse, recyclables, and/or compactors <br />29 <br />abut a public street frontage, a masonry screen wall comprised of materials <br />30 <br />similar to the building, or as approved by the Community Development <br />31 <br />Department, shall be installed to a minimum height to screen all activities. <br />32 <br />33 <br />1009.02.D.12: Conditional Uses; Specific Standards and Criteria <br />34 <br />12. Drive-through Facilities: <br />35 <br />a. Drive-through lanes and service windows shall be located to the side or <br />36 <br />rear of buildings and shall not be located between the principal structure <br />37 <br />and a public street. <br />38 <br />b. Points of vehicular ingress and egress shall be located at least 60 feet from <br />39 <br />the street right-of-way lines of the nearest intersection. <br />40 <br />c. The applicant shall submit a circulation plan that demonstrates that the use <br />41 <br />will not interfere with or reduce the safety of pedestrian and bicyclist <br />42 <br />movements. Site design shall accommodate a logical and safe vehicle and <br />43 <br />pedestrian circulation pattern. Adequate queuing lane space shall be <br />44 <br />provided without interfering with on-site parking/circulation. <br />45 <br />d. Speaker box sounds from the drive-through lane shall not be loud enough <br />46 <br />to constitute a nuisance on an abutting residentially zoned property or <br />47 <br />property in residential use. <br />48 <br />e. Drive-through canopies and other structures, where present, shall be <br />49 <br />constructed from the same materials as the primary building and with a <br />50 <br />similar level of architectural quality and detailing. <br />51 <br />f. A 10-foot buffer area with screen planting and an opaque wall or fence <br />52 <br />between 6 and 8 feet in height shall be required between the drive-through <br />53 <br />lane and any property line adjoining a residentially zoned property or <br />54 <br />property in residential use. <br />55 <br />Amdt14_DriveThrough_RCA_061713.doc <br />Page 2 of 4 <br /> <br />
