� � <br />a. That the vacated portion of the pedestrian easement be rededicated immediately <br />after the plat, Venture 4`" Addition is recorded. <br />b. Dedication of varying width and length land masses for County Road C as <br />indicated on the preliminary plat between Pascal Avenue and the frontage road. <br />c. Provision of a 10 foot wide utility and drainage easement along the east and south <br />property lines, and a portion of the west property line. <br />d. Provision of a 20 foot wide utility and drainage easement along the north property <br />line and a portion of the west property line. <br />e. Review and recommendation by the Parks and Recreation Commission regarding <br />park dedication consistent with State Statutes 462.358 and § 1103.07 of the <br />Roseville City Code. <br />f. Meeting any and all requirements of the Rice Creek Watershed and the Roseville <br />Public Works Department (necessary prior to the issuance of a building permit). <br />7.0 PLANNING COMMISSION ACTION: <br />7.1 On March 7, 2007 the Roseville Planning Commission held the public hearing regarding <br />the MSP Commercial request. No citizens addressed the Commission. <br />7.2 The Commission asked about the status of the park dedication requirement. The City <br />Planner stated he was unaware of a final decision by the Park and Recreation <br />Commission regarding this division of land and that State Law and the Roseville City <br />Code prescribe what the City is allowed to require and that if a fee is required it would be <br />collected at the time the building permit is issued. <br />7.3 The Planning Commission voted (6-0) to recommend approval of the request to <br />VACATE the existing PEDESTRIAN PATHWAY EASEMENT and recommended (6-0) <br />to approve the PRELIMINARY PLAT as requested by MSP Commercial, based on the <br />comments of Sectionn4, comments of Section 5 and Conditions of Section 6 of the <br />project report dated march 7, 2007. <br />8.0 SUGGESTED CITY COUNCIL ACTION: <br />8.1 ADOPT a RESOLUTION APPROVING the VACATION of a certain <br />PEDESTRIAN PATHWAY EASEMENT lying in the northeast quadrant of the parcel <br />addressed at 2700 Snelling Avenue; and <br />8.2 BY MOTION, APPROVE the PRELIMINARY & FINAL PLAT of VENTURE 4th <br />ADDITION subject to the conditions stipulated in Section 6 of the project report dated <br />March 26, 2007. <br />PF07-014_RCA_032607.doc Page 4 of 4 <br />
