Mr. Paschke advised that, in order to resolve the issues, and in <br />consultation with City legal counsel, the County Surveyor, property owner and <br />applicant, it was determined that the simplest solution was vacate the existing <br />pathway easement and support recording of the plat to create 2 lots; and would <br />ultimately achieve the goals and objectives of Ramsey County and allow the plat to be <br />re-recorded to support the land division. <br />Staff recommended approval of the PEDESTRIAN PATHWAY EASEMENT <br />VACATION AND PRELIMINARY PLAT, based on comments and findings of Section 5 <br />and conditions of Section 6 of the project report dated March 7, 2007. <br />Discussion included the status of park dedication requirements, usually not required <br />until a building permit was issued. <br />Appiicant, Alex Young, MSP Commercial was present. <br />Chair Bakeman closed the Public Hearing, with no one appearing for or against. <br />MOTION <br />Member Wozniak moved, seconded by Member Bakeman to RECOMMEND <br />approval of the Pedestrian Easement Vacation and APPROVAL of Planning File <br />07-014, two (2)-lot Venture 4tb Addition Preliminary Plat, based on comments and <br />findings of Section 5 and conditions of Section 6 of the project report dated March 7, <br />2007. <br />Ayes: 6 <br />Nays: 0 <br />Motion carried. <br />
