-� <br />4.0 REVIEW OF REQUEST <br />.-. <br />2 4.1 The existing property is about 60 feet wide and approximately 264 feet deep, has a total <br />3 developable area of 15,900 square feet, and has frontage along Dale Street as well as Alta <br />4 Vista Drive. <br />5 4.2 The parcel has a zoning designation of R-1, Single-Family Residence District, and a <br />6 Comprehensive Land Use Plan designation of LR, Low Density Residential. <br />7 4.3 The table below illustrates the dimensions and overall area of the proposed new parcels <br />8 compared to the minimum requirements established in the City Code. <br />9 <br />Parcel Width (ft.) Area (sq. ft.) <br />New Parcel A 60 128 7,700 <br />New Parcel B 60 126-148 8,200 <br />Minimum Code Requirements 85 I10 11,000 <br />� 0 5.0 STAFF COMMENTS <br />11 5.1 No new public street or public utility construction would be necessary to serve the <br />12 proposed new parcel, and while there is capacity in the system, a new sewer and water <br />� 3 lateral connection (at the owner's cost) would be necessary for new Parcel A; a private <br />14 easement on Parcel B in favor of Parcel A would be required to ensure the availability of <br />15 these utilities. Pursuant to § 1103.07 (Park Dedication) of the City Code, a park dedication <br />�6 fee would not be required because the area subject to the proposed minor subdivision is <br />17 less than one acre. <br />18 5.2 Drainage easements consistent with Code requirements cannot be accommodated on <br />19 Parcel B because of the location of the existing house, but would be required for Parcel <br />2o A. <br />21 5.3 Section 1012.01 (Lot Provisions) of the City Code specifies that any parcel that was <br />22 created prior to May 21, 1959, and that has dimensions and area of at least 70% of the <br />23 current minimum requirements is a legally buildable parcel even though it is smaller than <br />24 the Code's minimum standards. That is, a house may be built on any parcel having at <br />25 least 59.5 feet of width, 77 feet of depth, and 7,700 square feet of overall lot area, <br />26 provided that the parcel was created before May 1959. Although the dimensions and area <br />2� of the proposed new parcels would meet or exceed these 70% values, neither would <br />28 qualify as nonconforming-but-buildable by virtue of the fact that they will have been <br />29 created after 1959. <br />30 5.4 The area surrounding the current proposal was platted in 1876, and several parcels in the <br />3� triangle bounded by Alta Vista Drive, Dale Court, and Dale Street remain unchanged <br />32 from that original plat; most of these "original" parcels are smaller than the Code has <br />33 allowed since the ordinance was adopted in 1959.
