--� <br />4 December 2008 <br />Eugene Schultz <br />President, G&K Properties <br />7195 137`h Street North <br />Hugo, Minnesota 55038 <br />��� <br />�� <br />.-. <br />RE: PUD Agreement for Lexington Professional Building, 1940-1944 Lexington Avenue <br />Dear Mr. Schultz, <br />On March 24, 2008 I sent you a copy of the amended Planned Unit Development (PUD) <br />Agreement that was approved by the City Council on September 24, 2007 and that permitted a <br />broader set of uses at the above address — including The Bookshop. The City Code requires <br />newly-approved PUD Agreements to be sent to Ramsey County for recording within 60 days of <br />its approval by the City Council; although the Code does not establish procedures for processing <br />PUD Amendments so clearly, it would behoove you to sign and return the amended PUD <br />Agreement as soon as possible to minimize the possibility that its validity can be called into <br />question. <br />At your very earliest opportunity, please review the amended PUD Agreement, sign it in the <br />presence of a Notary Public, and return it to me. If it's convenient for you to sign and return the <br />document in essentially the same motion, several employees here at City Hall are Notaries. Once <br />I have received the document from you I will then have it signed by the City Officials and send it <br />to be recorded at Ramsey County; when the recorded document is returned to me, I will send you <br />a copy of the newly-recorded PUD Agreement to keep with your records. <br />I spoke to you this past summer about this same topic and, if I recall correctly, you still had the <br />materials I sent you in March.
