--. <br />^ <br />� 4.0 BACKGROUND: <br />2 4.1 Ms. Rezakhani owns the property at 425 Wagner Street, which has a Comprehensive Plan <br />.. designation of Low-Density Residential (LR) and a zoning classification of Single-Family <br />� Residence District (R-1). <br />� 4.2 This Conditional Use Permit (CUP) request has been prompted by the applicant's desire <br />6 to operate a home-based hair salon that would serve about 5 clients per week. <br />� 5.0 STAFF COMMENTS: <br />8 5.1 Section 1013 of the Roseville City Code allows the City Council to grant CUPs for land <br />9 uses that are conditionally permitted in a zoning district and to impose any additional <br />� 0 conditions deemed necessary to protect the public health, safety, and general welfare. <br />1 � 5.2 Section 1004.01 G(Home Occupations) of the City Code permits certain home <br />12 occupations on single-family residential properties, provided that the use is "secondary <br />13 and subordinate to the principal residential use of the property"; subsection 2j3 stipulates <br />14 that an in-home salon is a conditional use, thus a CUP is required. <br />15 5.3 Subsection 1004.01 G2a limits the total floor area dedicated to the home occupation to <br />� 5 30% of the of the floor area of the home or 600 square feet, whichever is less. <br />17 5.4 In addition to any residents of the home, Subsection 1004.01 G2b allows up to 1 full-time, <br />� 8 non-resident employee to work at a home-based business. <br />19 5.5 Subsection 1004.01 G2e allows a maximum of 2 additional vehicles to be parked on or <br />20 near the property at any one time that are related to the home occupation. More than any <br />21 other requirement, this provision would effectively prevent any substantial increase in <br />22 traffic and any problems related to excess vehicle parking. <br />23 5.6 Subsection 1004.O1G2f stipulates that deliveries of products, merchandise and supplies <br />24 may only be made by single rear-axle straight trucks or other vehicles commonly used for <br />25 deliveries in residential neighborhoods. <br />26 5.7 Subsection 1004.01 G2h allows hours of outwardly visible signs of operation, including <br />27 deliveries and client arrivals, between 8:00 a.m. and 8:00 p.m. <br />28 5.8 Planning Division staff believes that the requirements of § 1004.01 G, which regulate <br />29 home occupations and which have been excerpted above, are sufficient to ensure that the <br />30 proposed in-home hair salon will operate in a manner that is compatible with the <br />31 surrounding residential uses, pending the following review of CUP-approval criteria. <br />32 5.9 The State Building Code exempts private homes from accessibility requirements, but the <br />33 portions of the residence used for the business are subject to Federal ADA requirements. <br />34 No modifications to ensure accessibility are required prior to starting the business, but <br />35 certain modifications would be required at such time as alterations are made to areas <br />35 related to the business activity. <br />PF07-O51 RCA 092407 <br />Page 2 of 4 <br />
