The IUP shall be limited to the tenant space addressed as 2581 Fairview Avenue. <br />Should Mr. Theobald desire to expand into other vacated tenant spaces, an <br />amendment to this PERMIT would be necessary. <br />b. The IUP shall be allowed for a period of 5 years (August 13, 2007 to August 13, <br />2012) unless an extension is requested by Mark Theobald and/or ERP Minnesota <br />Portfolio, LLC three months prior to the above expiration date (May 13, 2012). <br />c. City Staff to review whether ADA and Clean Air Act requirements are met prior <br />to the issuance of a Certificate of Occupancy. <br />PLANNING COMMISSION ACTION: <br />On August 1, 2007, the Roseville Planning Commission held the public hearing regarding <br />the Theobald request. No citizens addressed the Commission. <br />7.2 The Commission asked about the standard time frame for an IUP (five years) and the <br />ability to extend and whether wording of condition 6.1b needed modification (none <br />taken). <br />7.3 Commissioner Wozniak asked whether the building or use was required to provide/create <br />handicapped accessibility. The City planner indicated that accessibility requirements are <br />addressed through the permit process. <br />7.4 The Commission voted (5-0) to recommended approval of the INTERIM USE PERMIT <br />for Mark Theobald and ERP Minnesota Portfolio, LLC, 2581, subject to three conditions <br />(As revised in 6.1 above). <br />8.0 SUGGESTED CITY COUNCIL ACTION: <br />ADOPT a RESOLUTION APPROVING the INTERIM USE PERMIT for Mark Theobald <br />and/or ERP Minnesota Portfolio, LLC, 2581 Fairview Avenue, allowing the premises to be <br />utilized as a softball and baseball training and instructional facility, based on the comments of <br />Section 5 and the conditions of Section 6 of the project report dated August 13, 2007. <br />Prepared by: Thomas Paschke 651-792-7074 <br />Attachments: Narrative, property location map, and aerial photo of parcel. <br />PF07-042_RCA_081307.doc Page 3 of 3 <br />
