It is necessary <br />because of the setback requirements. Under the residential district, a setback of <br />30 feet is required. On my plans I show the closest we get to the lot line is <br />27'6", Mr. Paschke has stated I am as close as 24'. I am sure Mr. Paschke is <br />correct with his number and I respectFully accept we need a variance of some 6'. <br />We are simply asking that a setback variance be granted in this case due to <br />some unique facts to the case. <br />• We are in a B-1 district which allows multi-family. Since we are putting a <br />multi-family building on the site, we have to fall under the Residences <br />District Uses. Putting the building within that district makes most since <br />and is very logical. However, in instances like setback, it doesn't work as <br />well. We are not dealing with two residences next to each other and their <br />respective lot lines. We are dealing with a B-1 entity and its B-1 abutter. <br />Which in this case it is largely a parking lot. <br />• We are using the existing building as a footprint. We are doing nothing <br />more here than taking a vacant, dilapidated building, and changing it into <br />a new building with a better use, that is far more visually appealing. We <br />are not trying to grow or change its footprint. <br />I respectFully ask that the Variance Board grant a variance for 2560 Fry Street <br />based on the preceding information. <br />;�_,,..�� _ � �� �._� ��.� �� �._ _�:.� , . . ,;�, . ���, . ��� �. ���.�. <br />
