� <br />7.0 PLANNING COMMISSION ACTION: <br />� <br />� 7.1 On June 6, 2007, the Roseville Planning Commission held the public hearing regarding <br />� the Rosedale Commons LP request for a CONDITIONAL UES PERMIT allowing <br />!� PetSmart to occupy the former Comp USA, at 2480 Fairview Avenue. <br />t� 7.2 At the hearing one neighbor adjacent (north) to the retail center did address the <br />�� Commission seeking better control over trash. He indicated a recent frustration with bags <br />��i and other trash blowing over the fence. <br />ll <br />i� <br />� �� <br />'u <br />,� <br />_� <br />,; <br />,� <br />,; <br />� t� <br />,; <br />7.3 The applicant representatives (Jeffery Jones of Fabyanske, Westra, Hart & Thompson, <br />P.A. (legal representative for Rosedale Commons LP) and Ellen Frank, Senior Counsel, <br />Land Use and Real Estate (PetSmart) also addressed the Commission indicating that it <br />was their desire to have the CONDITIONAL USE PERMIT approval recommendation <br />stipulate that the uses conducted within the PetSmart facility are permitted uses. They <br />also reviewed the operation of a PetSmart store. <br />7.4 The Commission voted (6-0) to recommend approval of the requested CONDITIONAL <br />USEW PERMIT subject to the inclusion of allowable uses stated as follows: The <br />CONDITIONAL USE PERMIT allowing use of the premises for retail sale o£ (i) <br />pets(including but not limited to fish, birds, reptiles, dogs, cats, and other small animals); <br />(ii) food, accessories and other products relating to pet and animals, including equestrian <br />products; and (iii) services related to pets and animals, such as grooming, boarding, pet <br />day care, animal training, and obedience classes, pet adoption and veterinary services." <br />8.0 SUGGESTED CITY COUNCIL ACTION: <br />,� 8.1 ADOPT a RESOLUTION APPROVING a CONDITIONAL USE PERMIT for <br />�{1 Rosedale Commons LP allowing PetSmart to occupy the former Comp USA tenant space <br />�t� within Rosedale Commons shopping center, 2480 Fairview Avenue, based on the <br />; � comments in Section 5, findings of Section 6, and the revised condition in Section 7 of <br />;- the project report dated June 18, 2007 (see attached resolution). <br />_� Prepared by: City Planner Thomas Paschke 651-792-7074 <br />�� Attachments: base map, aerial photo, and narrative. <br />PF07-026_RCA_061807.doc Page 4 of 4 <br />
