• <br />u <br />� 5.5 Drainage easements consistent with Code requirements are indicated on the survey. <br />L 5.6 Because the proposal creates an additional residential parcel, a park dedication fee may be <br />:? required pursuant to State Statute 462.358 and review and recommendation by the Parks <br /><r and Recreation staff as well as the Parks and Recreation Commission. <br />�> 5.7 City Code §1004.O1A6 (Maximum Total Surface Area) limits all single residential <br />{� parcels to a maximum total impervious coverage of 30% of the overall parcel area. Based <br />t on preliminary measurements, the proposed impervious surface area indicated on the <br />�> survey for each new parcel does not exceed this limit. Detailed measurements must be <br />� provided with applications for building permits, so compliance with impervious coverage <br />�_'; requirements will be addressed at that time. <br />5.8 All of the proposed building and driveway setbacks indicated on the survey meet or <br />exceed the minimum requirements established in § 1004.016 (Residential Setbacks) of the <br />City Code, except for a section of driveway turn-around shown along the northern <br />property line of the proposed Parcel A. Community Development staff will not support a <br />driveway setback of less than 2 feet; a Setback Permit will be required to allow an <br />encroachment into the required 5-foot setback. <br />� � 6.0 STAFF RECOMMENDATION: <br />1� 6.1 Based on the comments and findings outlined in Sections 4 and 5 of this report, the <br />19 Planning Division recommends approval of the request for a MINOR SUBDNISION to <br />20 allow the creation of three new parcels at 3077 & 3091 Fairview Avenue, subject to the <br />21 following conditions: <br />�?2 a. <br />23 <br />�'� b. <br />25 <br />26 <br />27 <br />28 <br />�9 <br />30 <br />31 <br />:32 <br />33 7.0 <br />Park dedication fee must be paid pursuant to determination by the Parks and <br />Recreation Commission and in accordance with State Statute 462.358; <br />Payment of the $1,500 Metro Area Sewer Availability Charge must be made upon <br />the issuance of a building permit for the proposed house on new Parcel B; and <br />c. Within thirty (30) days after approval by the City Council, the applicant shall <br />supply the final survey to the Community Development Director for review and <br />approval. A certificate of survey shall be required on all proposed parcels. After <br />completion of the review and approval by the City Manager, the survey shall be <br />recorded by the applicant with the Ramsey County Recorder within sixty (60) <br />days. Failure to record the subdivision within sixty (60) days shall nullify the <br />approval of the subdivision.
