� <br />4.0 REVIEW OF REQUEST: <br />• <br />�� 4.1 The two existing properties have a total frontage along Fairview Avenue of 311 feet and a <br />�� uniform depth of 215 feet; the total area of these two properties is 66,865 square feet. " This section further explains that the City Council is to hold the <br />� � public hearing for a proposed minor subdivision and has the authority to approve or deny <br />�tJ the applicant's request. <br />2i <br />z� <br />23 <br />24 <br />25 <br />2� <br />27 <br />28 <br />29 <br />sa <br />5.2 Mr. Westlund is in the process of securing a building permit to construct a new house on <br />the 3077 property, and this new house would remain on a property with the same address <br />(i.e., the existing parcel or proposed Parcel C) regardless of whether the proposed minor <br />subdivision is approved. Similarly, the submitted survey indicates that storm water from <br />the southern parcel is to be contained in a ponding area that is partially on the neighboring <br />property to the south. Although such drainage issues are outside the scope of a minor <br />subdivision (i.e., a drainage plan may not be required when the approval only pertains to <br />the boundary lines of three or fewer parcels), this condition does not comply with Code <br />requirements, and the applicant will have to prepare plans demonstrating that compliance <br />can be achieved prior to issuance of building permits. <br />31 5.3 The three proposed parcels meet or exceed all Code requirements for the size and shape <br />32 of new parcels, including side property lines that are perpendicular to Fairview Avenue. <br />33 5.4 No new street or utility construction is necessary to serve the proposed new parcel, and <br />34 while there is capacity in the system, a new sewer and water lateral connection (at the <br />35 owner's cost) is necessary for new Parcel B. <br />PF07-054 RCA 092407 <br />Page 2 of 3 <br />
