As a result of this as well as timing and financial <br />considerations, we are not recommending that we move forward with this intersection <br />relocation at this time. <br />Traffic Conditions: <br />The City's Traffic Engineer, SRF, has reviewed the Har Mar Traffic Study. The <br />following are conditions that should be included in the PUD agreement: <br />a. The right-in/right-out access located along County Road B, approximately 300 <br />feet east of Snelling Avenue, will be closed under future conditions as part of the <br />redevelopment of the Har Mar Mall. <br />b. The site plan in the northeast corner of the development (near the existing <br />Firestone auto service center) should be modified to relocate the east leg of the <br />internal intersection immediately adjacent to the County Road B/Har Mar Mall <br />Access (signalized) intersection further south. This will assist in traffic flow in <br />this area. <br />c. The site plan on the west side of the mall should be modified to update the <br />parking configuration in this area (i.e. 90-degree parking on the east and angled <br />parking on the west side of the drive aisle). <br />STAFF COMMENT — PLANNING DIVISION: <br />6.12 Section 1005.015 lists the permitted and conditional uses within the SC zone. Retail and <br />a Restaurant Class I- Traditional (no liquor), III - Traditional (3.2 beer and wine and <br />strong beer), and IV - Traditional (full service bar) are permitted uses. <br />6.13 Section 1006.04B defines 24 hour use, which reads: Twenry four (24) hour uses as <br />defined by Section 1002. 02 of this title shall be permitted uses in the S-C Shopping <br />Center District but uses within three hundred feet (300) of a residential district shall be <br />subject to the additional performance standards as indicated below. A significant change <br />in the regular hours of operation of any existing use to twenty four (24) hours located <br />within three hundred feet (300) of a residential district constitutes an expansion and <br />intensification of the use and shall require modification of the plan and improvements to <br />the site in compliance with the standards specified below for twenty four (24) hour uses. <br />(Ord. 123=�, 12-15-1999, eff. 1-1-2000) <br />PF07-053_RCA_011408.doc Page 6 of 13 <br />
