Communication: All uses within the S-C district shall have, and must post on the <br />exterior premises, a phone number that will be answered by persons with <br />authority, including the shopping center manager and the individual store <br />manager, to respond to customer concerns or complaints during business hours <br />or when other related commercial activities occur. <br />3. Security: Commercial properry owners shall be responsible for providing <br />frequent and thorough securiry monitoring of commercial areas closer than three <br />hundred feet (300) to a residential district or property line. <br />4. Site Maintenance: Commercial property owners shall be responsible for daily site <br />monitoring and site maintenance, including trash pickup in parking areas <br />bordering residential areas. (Ord. 1234, 12-15-1999, eff. 1-1-2000) <br />The proposal seeks to place the trash enclosure area on the east side of the structure <br />in a detached non-roofed enclosure area that is consistent with City Code. However, <br />given the proximity to residential uses and that each side of the building is visible <br />from either a public street, interior drive lane, or adjacent residential properties, the <br />Planning Division recommends that the structure be roofed. The other three <br />requirements listed above will be conditions of approval of the PUD Agreement. <br />PROPOSAL SPECIFIC COMMENTS: <br />6.25 The proposal seeks to develop a new 6,600 sq. ft. structure adjacent to County Road B at <br />a reduced setback than the 30 feet required by the City Code. The DRC has reviewed this <br />request/proposal and concurs with design and recommends that the minimum setback be <br />10 feet from the property line/roadway easement. <br />6.26 The proposed structure would include brick, stone, and EFIS, all compliant exterior <br />materials, and its height would not exceed the allowable three stories. The DRC <br />recommends that the structure have a height limitation of 26 feet to the top of the roof <br />parapet and that the trash enclosure include a roof of similar design to the building <br />enhancements. <br />6.27 Decorative down-cast lighting would complement the exterior of the building and provide <br />pedestrian safety. Measures shall be taken to revise all parking lot lighting in the <br />redevelopment area to be consistent with § 1006.OSI (Lighting). <br />6.28 <br />7.0 <br />The proposed restaurant patio shall be setback a minimum of 20 feet from the nearest <br />access exit lane. <br />STAFF RECOMMENDATION: <br />7.1 On November 7, 2007, the City Planner submitted the Planning Commission with a <br />revised set of conditions of approval for the Har Mar PUD Amendment.
