Regular Planning Commission Meeting <br />Minutes – Wednesday, January 2, 2013 <br />Page 8 <br /> <br /> Add Condition F with language to forbid any retail operations on site. <br />351 <br />Further discussion among staff and commissioners included a clear definition in City Code of <br />352 <br />“retail,” with staff further directed to specify and clarify that this operation is online mail order, not <br />353 <br />a retail operation on site; and how City Code would address or define greenhouse structures to <br />354 <br />ensure Mr. Carlson complied with his representation of the type of structures intended for the site <br />355 <br />to protect the City and neighbors. <br />356 <br />City Planner Paschke and Associate Planner Lloyd advised that agricultural elements or <br />357 <br />requirements didn’t apply, with the building code being more restrictive and offering more <br />358 <br />protections from that perspective, but not considering the greenhouse structures themselves as <br />359 <br />structures needing application of certain requirements. <br />360 <br />While not meaning any disrespect to the neighbors along Saint Albans, Mr. Paschke sought <br />361 <br />further clarification from the Commission for the actual number of delivery restrictions intended for <br />362 <br />this operation. Mr. Paschke noted that Saint Albans Street was designed for a higher use than <br />363 <br />this particular use would ever achieve, and while the vehicles for this use may be looked at <br />364 <br />differently, staff needed to know how to word the condition for the number of movements on that <br />365 <br />sight daily, since a single-family residential home averaged 9-11 movements daily; and sought <br />366 <br />clarification of the threshold intended by the commission for vehicles on this site. <br />367 <br />Chair Boerigter advised that he was considering only commercial vehicles. <br />368 <br />At the request for additional clarification from Mr. Paschke, Chair Boerigter advised that he was <br />369 <br />considering a large box truck, loading or unloading, and in direct relationship to Mr. Carlson’s <br />370 <br />representation of the limited impact to the neighborhood. Chair Boerigter opined that, if those <br />371 <br />representations did not become reality, it could influence the support of or lack thereof of <br />372 <br />commissioners for this request. <br />373 <br />Playing devil’s advocate, Mr. Paschke noted that a home-based business with daily deliveries <br />374 <br />from UPS or FedEx could have similar impacts to the neighborhood, and would that the City <br />375 <br />would not have any ability to regulate that traffic at all. <br />376 <br />Chair Boerigter recognized Mr. Paschke’s comments, however, he advised that his intent was to <br />377 <br />allow Mr. Carlson enough leeway to operate his business along the lines that he represented to <br />378 <br />the commission and public, while offering some protection and monitoring capacity for the City. <br />379 <br />Member Olsen concurred with Chair Boerigter, and expressed confidence that staff could come <br />380 <br />up with a reasonable number for delivery/pick-up commercially rated vehicles. <br />381 <br />Ayes: 6 <br /> <br />382 <br />Nays: 0 <br />383 <br />Motion carried. <br />384 <br />Anticipated City Council action is scheduled for January 28, 2013. <br />385 <br />6.
