[location map] The variance request is prompted by the applicant's desire to construct a <br />detached garage adjacent to an undeveloped portion of the Rose Place right-of-way. <br />[survey] When the Livingstons tirst approached Community Development staff to figure <br />out what approvals they'd need to put a garage in this location, staff was unsupportive of <br />a variance because the possibility of a right-of-way vacation had not yet been explored. <br />Although there City staff initially supported the requested vacation, staff ultimately <br />withdrew support upon further consideration of potential future redevelopment of the <br />manufactures home park. Now that it's clear that a right-of-way vacation is not viable, a <br />variance is the only remaining option. <br />The proposed detached garage and subsequent driveway expansion will not create any <br />nonconforming conditions except for the side setback. <br />Because Community Development staff has determined that hardships exist which are <br />not created by the property owner and that granting the variance would not compromise <br />the public health, safety, or general welfare, staff recommends approval of the variance <br />request. <br />J1� - � ;U/k o v�- <br />- u� l� Ow <br />c,on ( . c, <br />� � .t ✓►c � o .,.�l� �.H.� �.� c�,+iv�e,�Ja..� <br />/ <br />
