It is always the case with Setback Permits that - assuming the <br />request is approved - applicants can begin their project after an appeal period of 10 days <br />has passed. Moreover, I haven't talked to anyone on the review committee, so I don't know <br />if any of them feel differently about the current proposal than they did about the <br />original one. Since you aren't able to be at the hearing this time, I will make your <br />comments known to the other revie�aers and I will keep you apprised of the Community <br />Development Director's decision ir, case you feel like an appeal would be appropriate. <br />You also raised the issue of "hardship". You're absolutely right that variances require <br />that an applicant demonstrate that strict enforcement of the Code would cause some kind of <br />undue hardship. But the Setback Permit is intended to facilitate ongoing improvements to <br />resider.tial properties so that our housing stock continues to be well cared for; while <br />these improvements may not meet all of the Code's standards, the City Council has <br />authorized the judicious approval of minor projects that satisfy a series of criteria bu*_ <br />that may not meet the requirements for a variance. <br />Thanks for yonr input. I was somewhat surprised at April 18 <br />letter, which seems tc favor the proposal since the size has changed, indicating how <br />quickly a perrr�it could be issued. I thought the city would always enforce rules except in <br />cases of hardship wher there is no other choice. I am convinced a builder or architect <br />could desiyn an addition not requiring a variance. <br />The issues are not as much size as proper spacinq of homes, maintenance of neighborhoed <br />appearance which affects property values, and avoidance of variances. I remain opposed *_o <br />this proposal. <br />You should know that the family at 1892 Eldridge, west of the Rhees, who were at the Mar. <br />6 hearing in opposition, are away perhaps on a visit to China, according to other <br />neighbors.
