Commissioner Boerigter reviewed the concerns expressed during public comment (i.e., crime <br />and traffic), but clarified that tonighYs discussion and consideration was for the pawn shop use. <br />Commissioner Boerigter noted that many comments were made about traffic and the apartment complex, <br />not about the pawn shop use, and opined that there were other uses allowable in this zoning district <br />under a CUP that would create more traffic, and further opined that the pawn shop would not significantly <br />impact traffic. Related to crime concerns, Commissioner Boerigter noted the testimony of Lt. Rosand that <br />no additional crime was anticipated from the pawn shop use, or had been experienced from similar <br />operations. Commissioner Boerigter advised that, now that he better understood the applicanYs business <br />model and the pawn process, and based on City Code for CUP approval, that states that upon meeting <br />certain tests or criteria, the use was allowable and approval was indicated. Commissioner Boerigter <br />noted that people's judgment could be clouded based on stereotypes and perceptions of clientele at pawn <br />shops, in addition to questions of whether this was ideal for Roseville. However, Commissioner Boerigter <br />opined that, while he understood concerns as expressed, and was not originally supportive of the CUP, <br />he would vote to support it. Commissioner Boerigter further opined that the use would not prove <br />detrimental to the neighborhood, but that if a huge increase in calls was experienced directly related to <br />the pawn shop, he trusted the City' Police Department to take action, based on the restrictions of the <br />pawn shop license requirements. <br />2H� Chair Bakeman opined that it was unusual and unfortunate that this neighborhood had experienced so <br />2t3a many applications over the last few months; while recognizing that a landlord would want to lease <br />2t3_� property to a good tenant. Chair Bakeman also noted that she'd been skeptical of a pawn shop use; <br />2�o however, after hearing from Lt. Rosand and Mr. Smith, she was less skeptical; while also expressing trust <br />29 i in the Community Development Department staff to ensure that the exterior of the building would be up to <br />2� % code. Chair Bakeman spoke in support of the CUP. <br />29s <br />2qt <br />29': <br />29u <br />29? <br />293 <br />2?� <br />3oc <br />30: <br />MOTION <br />Member Bakeman moved, seconded by Member Boerigter to RECOMMEND APPROVAL of the <br />CONDITIONAL USE PERMIT for Rosewood Center Partners and Mark Smith (dlbla Cash-n-Pawn), <br />allowing the proposed pawn shop to operate at the specific tenant space identified on the ftoor <br />plan, the former Mattress Giant space located between current tenants Kinko's/FedEx and China <br />Jen within the Rosewood Shopping Center at 2181 — 2195 Snelling Avenue, in compliance with the <br />requirements and regulations established in Roseville City Code, Sections 1005.015, 1013.01 and <br />317; based on the comments and findings outlined in Sections 5 and 6, and subject to conditions <br />detailed in Section 7 of the project report dated April 2, 2008; amended as follows: <br />3oz • Staff will identify and provide specific square footage of the above-referenced lease space as <br />3U3 detailed on the floor plan as presented; with the applicant understanding that any additional <br />3oa square footage or expansion will require an amendment to the CUP; <br />30 ; • Revision of Condition "a" in the project report to read: "The Roseville Police Department <br />30o monitoring the number of calls to the Cash-n-Pawn site." Deleting language comparing those <br />3o i ca/ls to the existing Pawn America to determine a base and/or threshold; <br />zo8 • Condition "b" remaining as specified in the project report; and <br />30� • Addition of Condition "c° that shall specificalty prohibit the following activities: no check <br />3 i �� cashing; no purchase, disp/ay or sale of pornographic materials; no purchase, display or sale <br />3 i i of firearms; no payday loans <br />3�- Chair Bakeman called for Mr. Trudgeon to take a roll call vote.
