Draft Planning Commission Minutes Attachment E <br />t Request by Red Dog Holdings, LLC (d/bla Cash-n-Pawn) for approval of a CONDITIONAL USE <br />2 PERMIT to allow a pawn shop in an existing retail center at 2187 — 2195 Snelling Avenue. <br />3 Chair Bakeman opened the Public Hearing for Planning File 08-014. <br />a Associate Pianner Bryan Lloyd reviewed staffs analysis of the request, noting that the subject tenant <br />5 space was located between Kinko's/FedEx and China Jen within the Rosewood Shopping Center. Mr. <br />s Lloyd advised that the appiicant has seventeen (17) such stores located in the States of MN, MO, and IN, <br />� and will not be cashing checks that would require separate licensing, nor will they be seeking licensure for <br />a selling guns or pornographic materials. <br />9 Mr. Lloyd advised that representatives of the Roseville Police Department and Planning Division had met <br />�o previously to review the proposal of Red Dog Holdings to establish a pawn shop in the vacant tenant <br />�� space at Rosewood Shopping Center. Mr. Lloyd noted that at that meeting, the Police Department <br />�z indicated that they had a good relationship with Pawn America and would expect a similar relationship <br />i3 with Cash-n-Pawn, with the Police representative further stating that City Code, Section 311 <br />ia (Pawnbrokers and Precious Metal Dealers) govemed the licensing and operational requirements for such <br />is uses. <br />�6 Mr. Lloyd advised that Police Department staff indicated that a pawn shop is no more likely to have illegal <br />�7 activity or police calls than a general retail business; unless a substantial increase in police calls due to <br />�8 illegal activities or loitering in the parking lot was found, at which time the CUP would be revisited, and <br />19 was addressed in staffs recommended conditions as detailed in the project report related to monitoring <br />2o calls to the site and discretion of the Police Department. <br />2 i Staff recommended APPROVAL of the request for a CONDITIONAL USE PERMIT to allow the proposed <br />22 pawn shop to operate in compliance with the requirements and regulations established in Roseville City <br />zs Code, Sections 1005.015, 1013.01 and 311; based on the comments and findings outlined in Sections 5 <br />2a and 6, and subject to conditions detailed in Section 7 of the project report dated April 2, 2008. <br />25 Commissioner Wozniak questioned whether it was appropriate to have a condition of approval that the <br />26 City's Police Department be required to provide additional monitoring. <br />27 Mr. Lloyd responded that this was for the purpose of reiterating notice to the applicant that there would be <br />28 ongoing monitoring, and that monitoring would be used as a resource to evaluate criteria for continuing <br />29 the CUP shouid any problems develop. <br />30 Discussion included the preference of the Police Department to avoid assigning an arbitrary numerical <br />3� threshold as part of the approval criteria; and clarification of the location of Pawn American in Roseville <br />3z (Rice Street at Larpenteur Avenue). <br />33 Community Development Director Trudgeon advised that the pawn shop license was an additional <br />3a monitoring device for the applicant for day-to-day operations, with any violations potentially causing the <br />35 CUP to become void as well as their license revoked. <br />36 Commissioner poherty sought verification that the pawn shop would not be offering check cashing <br />3� services or pay day loans. <br />3� Mr. Lloyd advised that the pawn shop would not be offering such services, and clarified that those <br />39 services would fall under different City, County and/or State licensing criteria and requirements, and were <br />ao not part of this land use application. <br />4� Commissioner Boerigter questioned if the CUP would apply only to the proposed space at this time, or if it <br />42 could be expanded to include additional square footage within the same strip center. <br />a3 Mr. Lloyd advised that a CUP was recorded with Ramsey County and stayed with the property, not the <br />aa applicant; and advised that this applicant would need a new CUP to operate at a different location; and <br />a5 could operate on the property identified in the CUP application. <br />as Mr. Trudgeon suggested that the Commission could specifically condition their action on tying the CUP <br />a7 application to a specific piece of property within the strip ma�l, as well as a condition specifying that no <br />as cash lending would be allowed; thus making it necessary for the applicant to apply for an amendment to <br />49 the CUP for any additional operations to make sure the City and public were aware of those changes. <br />so Applicant, Mark Smith, 19545 Hampshire Court, Prior Lake, MN (owner and CEO of Cash-n-Pawn) <br />5 i Mc Smith advised that he operated a combined eighteen (18) stores in the states of MN, MO and IN, with <br />5? ten (10) of those stored in MN; and that the company had been in business for twenty-one (21) years. <br />.�. ,� <br />
