� ^ <br />Pursuant to Minnesota law, the applicant has the burden of proving that the proposed use <br />will not have an adverse impact in regard to any of these factors; and <br />WHEREAS, the Roseville City Council concluded that the applicant did not show <br />that the proposed use would be consistent with the factors set forth in the Roseville City <br />Code for the issuance of a conditional use permit; and <br />WHEREAS, after considering all of the evidence, and duly discussing the matter, <br />a motion was made at the Apri128, 2008 Roseville City Council meeting to deny the <br />conditional use pennit application; and <br />WHEREAS, that motion passed on a three to one vote, with all Council members <br />supporting the motion stating on the record the reasons for their support of the denial of <br />the request for a conditional use permit; and <br />WHEREAS, staff and the City Attorney were directed to prepare findings of fact <br />based upon the record and the reasons for denial as stated by Council meinbers at the <br />time of the vote to deny the conditional use pennit application. <br />NOW, THEREFORE, BE IT RESOLVED, that the Roseville City Council hereby <br />adopts the following Findings of Fact for the denial of the conditional use permit <br />requested by Red Dog Holdings, LLC. <br />FINDINGS OF FACT <br />A. The Roseville City Council finds that the proposed use will have an adverse <br />impact on inarket value of surrounding properties. <br />B. The Roseville City Council finds that the proposed use would have an <br />adverse impact on public facilities in the area. <br />C. The Roseville City Council finds that the proposed use will have a negative <br />impact on the general public health, safety and welfare. <br />Evidence in the record that supports these findings includes the following <br />facts: <br />The record indicates that the location of the proposed use is near an <br />elementary school and a residential area. Other inajor retail <br />businesses are also close by in the area. <br />2. The record shows that an existing pawn shop located in the City of <br />Roseville has had incidents of criininal behavior associated with it, <br />2 <br />
