� <br />3.0 PUD APPROVAL <br />.-. <br />The CiTY hereby grants approval of the Planned Unit Development (identified as Exhibits A <br />through J in Section 4.0 of this Agreement), subject to the DEVELOPER's compliance with the <br />terms and conditions of this Agreement. The City agrees to approve applications for building <br />permits, if said applications are consistent with the plans identiiied in Section 4.0 below. <br />For any improvements proposed thereafter, notwithstanding anything in this Agreement to the <br />contrary, the CITY may require compliance with any amendments to the its Comprehensive <br />Guide Plan, off'icial controls, platting or dedication requirements enacted after the date of this <br />Agreement. <br />4.0 APPROVAL by the CITY <br />The CITY hereby approves the following plans on file with the City. The DEVELOPER shall <br />develop the subject property in accordance with these plans. If, however, the plans vary from <br />the written terms of this Agreement, the written terms shall control. If the plans address items <br />not specifically addressed in this Agreement, the plans shall govern with respect to those items. <br />The plans are: <br />Exhibit A Topographic survey of 495 Iona Lane including all land features, dated <br />November 13, 2001. <br />Exhibit B Final Plat (not recorded version) of Owasso Ridge, dated March 12, 2002. <br />Exhibit C Site development plan that includes property boundary, existing contours, <br />existing easements, building setbacks, structure location (building pads), <br />curbing, and parking setbacks (each individual development project), dated <br />February 14, 2002. <br />Exhibit D Grading plan illustrating existing grades and those proposed after completion of <br />the proposed construction, drainage directions, spot elevations, catch basins for <br />surface water catchment; utility plan indicating existing and proposed sanitary <br />sewer, watermain, gas, electric, and storm sewer connection; and the erosion <br />control plan, dated February 14, 2002 <br />Exhibit E Tree Preservation/landscape plan including materials list, sizes, and locations of <br />all plant materials, dated February 12, 2002. <br />Exhibit F Building elevations and floor plans of the four home designs, with design <br />component details and dimensions, dated January 22, 2002. <br />Exhibit G Draft homeowners Association by-laws. <br />
