�.. ... <br />annually) commencing January 1, 2002. Annual assessments shall be <br />payable in monthly installments due on the 1 u day of each and every <br />month. <br />N. Any annual or special levied assessment as set forth in this Declaration <br />shall become a lien on the effected real estate as soon as the assessment <br />is due and payable as set forth above. In the event the owner fails to pay <br />the assessment when due, then the assessment shall bear interest at the <br />maximum legal rate permitted by law in Minnesota, from the date when <br />the assessment is dueuntil it is paid in futl. The unpaid assessments <br />shall become liens against (ots and personal obligation of the owner. It <br />shall be the duty of the Association to bring actions to enforce such liens <br />and collect from such Owners. The Association, in its discretion, may <br />file certificates of non-payment of assessments with the Ramsey County <br />Recorder stating the amount of the assessment lien. The lot owner shall <br />be responsible for, and the assessment lien shall include, all costs of <br />colfection, including legal fees, incurred by the Association. <br />I. In the event legal proceedings are commenced to enforce any provision <br />of this Declaration, or if the services of an attorney are retained by the <br />Association in connection with the same, and the Association prevails in <br />its claim, the non complying fot owner or Owners shall be obligated to <br />pay all costs incurred, plus reasonable attorney's fees, which costs and <br />fees shail become a lien against the affected real esta[e. <br />1. The assessments levied by the Association shall be used exclusively for <br />the following purposes: <br />(I) Mowing and Fertilizine Lawns. Watering lawns (including <br />maintenance of the sprinkler system) shall be the responsibiliry of <br />the Association. <br />(2) Plowine and Removal (if necessarv) of Snow from the <br />Drivewavs. Snow removal from sidewalks shall be the <br />responsibiliry of the homeowner, unless the Association decides <br />to include this service. <br />(3) Enforcing any and all building and land use restrictions that exist <br />in this Declaration or which may be lawfully imposed on the <br />Properry. <br />(4) Paying the expenses necessary to carry out the Association <br />business including attorney's fees, managers fees, expenses of <br />liabiliry insurance, bookkeeping and accounting expenses, and <br />other expenses that may from time to time, be deemed necessary <br />� <br />
