-� -, <br />5. Associuion. The Owners of each lot herein shall become a member of the <br />Owasso Ridge Homeowners' Association, Inc., a Minnesota non-profit <br />corporation. Each owner shall be entided to one vote in the Associatiods <br />business. The Association and lot Owners shall have the following <br />responsibilities, duties, and obligations: <br />A. By acceptance of a Deed or other instrument of conveyance for his or her <br />lot within the Plat, each lot owner shall be deemed to covenant and agree <br />to pay to the Association annual assessments and special assessments for <br />Association expenses. Assessments shall be fixed, established, and <br />coilected from time to time, as provided in this Declaration shall be <br />subject to change by the Association. <br />B. The annual and special assessments, together with interest and costs of <br />collec[ion as provided below, shall be a continuing lien on Ihe lot <br />effected and shall also be a personal obligation of the owner of the <br />Property and the date when the assessment is due. Such personal <br />obligation shall not pass to successors entitled to the effective Property <br />unless expressly assumed by the successors. <br />C. Unless changed by a vote of over 50 percent of the lot Owners, the <br />annual assessment for any lot in the Plat shall be that of the amount last <br />approved by 50 percent of the lot Owners. <br />D. A vote of the members of the Association, in the manner set forth below, <br />[he Association may levy, in addition to annual assessments, a special <br />assessment or assessments in any calendar year, applicable to that year <br />only, for the purpose of defraying in whole or in part, the cost of any <br />extra ordinary expense incurred by the Association. <br />E. Any special assessment must be approved by the Board of Directors of <br />the Association and have the assent of more than 50% of the votes of [he <br />lot Owners in a meeting called for that purpose. Written notice of a <br />meeting called for such persons shall be send to members of the <br />Association at least 10 days in advance of the date of the meeting setti�g <br />forth the purpose of the meeting. <br />P. It shall be the duty of the Association to notify all Owners or convact <br />purchasers of the lots within the Plat, whose addresses shall be supplied <br />ro the Association, by sending written notice to each of the Owners <br />within ten days after the date the assessment has been fixed and levied <br />giving ar� amount of the charge for the assessment for the current year, <br />when the same shall be due, and the amount due for each lot owner. <br />G.
