� <br />� �; I <br />� � <br />September 28, 2009 <br />Mr. Riaz Hussain <br />2333 Maple Lane East <br />Maplewood, MN 55109-1538 <br />RE: 1901 Lexin��ton Avenue, Roseville <br />Dear Mr. Hussain, <br />.--. <br />On June 29, 2009 you addressed the Roseville City Council to reconsider their decision to require the <br />removal of the parking areas on your property at 1901 Lexington adjacent to Autumn Street. During the <br />conversation with the City Council, Mayor Klausing indicated that while he and some other members of <br />the City Council had some recollection of the issue, they did not recall all of the details of the <br />circumstances that led to the Council's decision in March 2008 to enforce the pertinent provision of <br />Resolution No. 9414 approved in 1997. <br />In order to make a more informed decision of your request, the Mayor asked that Planning Division staff <br />provide the Cotu�cil with the basic information detailing the issue. The Mayor indicated that if after <br />reviewing the information the Council wished to rescind its previous decision, the item would be put on a <br />future Council agenda. This would allow the City to notify nearby property owners prior to acting on the <br />matter. I have enclosed a copy of the information provided to City Council for your reference. <br />To date, City Council members have not expressed a desire to relook at the matter and thus it appears that <br />the City Council still supports its decision of March 24, 2008 to require that the parking areas be removed <br />and replaced with grass and/or other landscaping. In order to avoid formal Code Enforcement action, I <br />would again request that you secure the permit required for removing the parking areas and installing the <br />corresponding curbing along Autumn Street by October 16, 2009 and seed the areas or cover tllem with <br />sod. If you fail to do so by that date, we will forward the case to the City Attorney for further action. <br />As an alternative, you could attempt to amend the original Conditional Use Permit approved in 1997 to <br />remove the condition that gives the city the discretion to declare the driveway/parkway unsafe and also <br />ask the City Council to rescind its decision from 2008. At this point, staff does not see a compelling <br />reason for the conditional use permit to be amended, and would not support a change to the Conditional <br />Use Pe�mit. It will be for you to state the case for changing the existing conditional use pennits and for <br />you to not be required to remove the driveway/parking area along Autumn St. Nevertheless, you do have <br />the ability to ask for this to be considered. The application fee for this request is $600.00 and will require <br />a public hearing at the Planning Commission with the surrounding neighborhood notified of the meeting <br />and your request.
