� <br />� <br />T'his section of the CUP application and narrative asserts that the site will be in <br />compliance with state noise standards. 1t is the noise criteria of the City that must be met v <br />in order for the proposed plant to receive an appt�oved CUP. <br />I�urther, the narrative in tlie noise section is absolutely silent on the issue oi�railroad <br />noise. The CUP application narrative at page 1 and again at page 4 indicates that some <br />proportion of the a�greaates used at the proposed plant are expected to be provided via <br />rail. Railroad operations are noisy. The n�ise associated with rail operations such as <br />moving a�id placing the rail cars, and the noise associated with dumpin� ag�regate fi-om <br />the cars and con��eying it to the proposed stockpiles, is not even mentioned <br />Once again; it is impossible not to conclude that the CUP appiication and nan�ative is <br />misleading. In the case of noise it is misleading tllrough a virtual absence of analysis and <br />fiill disclosure of the possible sources of noise, and the magnitude and duration of noise. <br />This should lead the Council to turn down the CUP application and require a new CUP <br />application if the proposer should choose to move forward. <br />Conclusion <br />A fair analysis of the CUP Application and Narrative and further data presented in the <br />EAW circulated this past summer leads to the conclusion that the CUP Application <br />contains numerous very serious errors and omissions. These errors; in some cases ei1•ors <br />eaceedinb 100 percent, should lead the Roseville City Council to Reject the Conditional <br />Use Application submitted by Bituminous Roadways. <br />� <br />� <br />
