� <br />RESOLUTION No. 10861 <br />- <br />A RESOLUTION DENYING A CONDITIONAL USE PERMIT <br />FOR BITUMINOUS ROAllWAYS, INC. FOR THE OUTDOOR STORAGE OF <br />AGGREGATES <br />WIiEREAS, an Application was submitted by Bituminous Roadways, Ina ("Bituminous <br />Roadways") for consideration of a Conditional Use Permit to allow for the outdoor storage of <br />aggregates in connection with the operation of an Asphalt Plant; and <br />WHEREAS, the Application is for property located at 2280 Walnut SVeet in Roseville, <br />Minnesota, legally described as follows: <br />See attached Exhibit A <br />; and <br />WHERFAS, afrer due notice the Roseville Planning Commission held a public hearing <br />on May 6, 2009, regatding the Conditional Use Application in accordance with state law and city <br />ordinance, at which time oral and written testimony was presented by the Bituminous Roadways, <br />its agents,residents, and other interested persons; and <br />WHEREAS, following the Planning Commission meeting thc City has received <br />additional documents, reports, correspondence and other evidence from interested parties <br />pertaining to the Conditional Use Permit Application, all of which is included in the rewrd on <br />this mat[er and incorporated herein by teference; and <br />WHEREAS, the City Council at a special meeting held on November 29, 2010, received <br />the Planning Commission's recommendation, the City staff report and further written and oral <br />testimony from Bituminous Roadways and other interested persons; and <br />WHEREAS, the City Council upon consideration of the Application, the staff report, and <br />all other information received from interested par[ies constituting the record on this Application, <br />and upon further deliberation, makes the findings in this Resolution as a contemporaneous record <br />of the Council's decision; <br />NOW THEREFOR� BE IT RESOLVEll by the City Council of the City of Roseville, <br />Minncsota, that it adop[s the following findings regazding the subject Application for a <br />Conditional Use Permit: <br />1. Bituminous Roadways has submitted a Conditional Usc Application to the City <br />stating that it intends to construct an Asphalt Plant on the subject property with <br />outdoor storage oP aggregates. 7'he Asphalt Pl�nt wil] include the manufacture and <br />distribution of asphalt the outdoor storage of aggregates; the storage of finished <br />asphalt and asphalt cement (a binder material in asphalt production) in sealed tanks; a <br />
