-� <br />,-. <br />Ordinance, the outdoor storagc of aggregates, the storage of materials in enclosed <br />tanks and crushing operation activities aze not permitted uses. Consequently, the <br />Asphalt Plant proposed by Bituminous Roadways is not a permitted use in an I-2 <br />Zoned District under Section ] 007.015 of the Original Ordinance. <br />8. The use of the subject property for an Asphalt Plant is not a permitted use under <br />the Performance Standazds stated in Section 1007.O1D of the Koseville City Code <br />for the following reasons based upon evidence which has been presented to the <br />City Council as well as the following specific sources: <br />A. The proposed crushing operation as part of the asphalt plant proposal will <br />create noise to a level constituting a nuisance to the surzounding area <br />prohibited under 1007.01(D)(1) of the Roseville City Code, specifically at <br />2501 Walnut Street, a commercial office building, where thc decibel levels <br />will exceed the commercial daytime standazds for noise under the State of <br />Minnesota Pollution Control Agency noise standards, and at 2431 St. Croix <br />Street, an industrial use, where the decibel levels of the alternative crusher <br />will exceed the daytime industrial standazds under the State of Minnesota <br />Pollution Control Agency noise standazds. The proposed asphalt plant proposal will emit particulale matter in such a <br />manner that will constitute a nuisance to the surrounding area prohibited by <br />Section 1007.01(D)(2) of the Roseville City Code. The draft air quality <br />permit shows a potential emissions of 39.16 tons with half of these emissions <br />being larger particulate mattcr that have the potential of settling on nearby <br />surrounding properties and air intakes creating a nuisance for the building <br />owner and tenants .(Sowce: Letter dated 5eptember 10, 2010 from Joseph <br />Maternowski, Moss and Bamet, representing UC06 Roseville MN LLC, <br />property owner of 2501 Walnut Street, Roseville, pg 12-13). <br />C. The proposed asphalt plant proposal will emit particulate matter in a manner <br />that will constitute a nuisance to the surrounding area prohibited under <br />1007.01(D)(2) of the Roseville City Code. Specifically, particulate matter <br />known to cause respiratory and cardiovascular disease will be at the ma�cimum <br />emission ]evel allowed under the Nalional Ambient Air Quality Standards <br />(NAAQS) as measured over a 24-hour period. These emissions cause serious <br />public health concerns for certain populations.
