Section 1005.015 of the Roseville City Code stipulates that a Restaurant Class IV <br />— Traditional with "live entertainment and/or dancing" requires an approved CUP. The <br />current use of the premises is a permitted use under the same section of the Code. <br />Because the site had limited parking (172 spaces) the owner was required to enter into <br />agreements with adjacent/adjoining properties for sharing off-peak hour parking. This strict <br />requirement was necessary to ensure that adequate (Code required) parking was achieved given <br />the multiple uses that could occur at any one time. However, since the issuance of that permit, <br />the owners have terminated their agreement with Clear Channel Communication and have <br />changed the name of the restaurant and auxiliary uses to Big City Tavern & Banquet Center. <br />The business also does not have the traffic originally anticipated by staff when first reviewed. <br />The original structure was built in 1986, is located on 2.4 acres, has a Comprehensive Land Use <br />Plan designation of Business, is located in Planning District 10, and the property is zoned B-2, <br />Retail Business District. <br />25 The proposed dinner theater would occupy the Twin Cities Room. This banquet room <br />26 historically has been booked 30 - 40% of the available time on Friday and Saturday nights and <br />27 for large wedding parties — up to 200 people. The estimated capacity for Oops Theater is 100 <br />28 people, which is about half of the capacity of the Twin Cities Room. The reduction is due partly <br />29 to the portable stage/performance area, but also to the design of the seating area. Oops Theater <br />30 anticipates an initial Friday and Saturday evening performance (6:00 to 10:30); a Sunday <br />31 matinee (12:00 to 4:15); and a weekday matinee (12:00 to 3:30), which times will not typically <br />32 conflict with the peak customer volume of the bar/restaurant. On a typical Friday or Saturday <br />33 evening the sit-down restaurant is busy between 5:00 and 8:00 p.m. while the bar has limited <br />34 patrons. After 8:00 p.m. the bar area has seen an increase in patrons while the sit-down <br />35 restaurant has seen a reduction. Currently the facility (bar and restaurant portion) is <br />36 experiencing a capacity of 60% or less on a Friday or Saturday evening. <br />37 <br />38 Section 1018.08 of the Roseville City Code requires on-site parking at a minimum of: 1 space <br />39 for every 2.5 seats in the sit-down portion of the restaurant; 1 space for every 20 sq. ft. of bar, <br />40 lounge, public area, and game room; 1 space for every 50 sq. ft. of each skybox; 1 space for <br />41 every 50 sq. ft. of banquet area; and 1 space for every 5 seats in the outdoor seating area. The <br />42 site has 172 spaces and the owners has a contract (Edina Realty lot) for 98 spaces and verbal <br />43 agreements (Ford and North Suburban Clinic) for 106 spaces, for a total useable parking <br />44 allowance of 376 spaces. <br />45 <br />
