6.0 PLANNING COMMISSION ACTION: 6.1 On June 7, 2006, the Roseville planning Commission held the public hearing regarding the ACR request. No citizens were present to address the Commission, however, the -� — Commission did have questions of staff and the applicant. 6.2 Specifically, given the complicated aspects of the request (as required by staff/city attorney) the Commission was unclear of exactly what was to be recommended far approval. The City Planner indicated that the main purpose of this request is to establish a list of uses that will be permitted through the Planned Unit Development Agreement along with the pre-existing site conditions. Section 5.12 a- c was the Planner's attempt at a list of uses that generates little or no measurable impact. 6.3 The City Planner also introduced a specific request of the applicant to allow a used vehicle dealership for up to 5 vehicles on the premises. The site currently has a vehicle rental and leasing business which allows the sales of those vehicles that have been rented/leased. This low impact use has been reviewed for its potential impacts for which the Planner concluded that no measurable impact to the health, safety, and general welfare of the community/area would occur and that the Commission can add specific conditions to minimize the use. 6.4 The Commission asked the applicant a number of questions regarding the proposed use and others (current/future) in the strip center. The Commission also asked the City Planner specific questions regarding process and the creation of a list of permitted uses. Given the oddity of this request, the Commission did become confused in the process, as well as in its understanding of this planned unit development versus others that have come before them for support. The City Planner attempted to provide guidance on this request by clarifying the purpose of the hearing and explaining the significance of Section 5.12 of the project report. 6.5 The Planning Commission voted (7-0) to recommended approval of the request by ACR Homes and the Community Development Department for a PLANNED UNIT DEVELOPMENT AMENDMENT & ESTABLISHMENT of a PLANNED UNIT DEVELOPMENT AGREEMENT stipulating terms and conditions, specifically accepting the uses identified in 5.12 a and b as permitted and subject to the following conditions: a. The used vehicle dealership shall be limited to 5 vehicles/display spaces. b. The used vehicle dealership display spaces shall be located along the rear (west) of the structure adjacent the sales office. There shall be no accessory use associated with the used vehicle dealership such as auto detailing. d. An adult daycare shall be a permitted use. PF3730_RCA_062006.doc Page 6 of 7
